Another shooting in our community yesterday. We hope that you and your friends, families, and co-workers are all alright. If you or someone you know needs help, please get it. Rumor is that Marshal Willick went off about the Our Nevada Judges writs and Alex Falconi during the Advanced Family CLE. Apparently he’s no longer claiming sealed cases are few and far between; he’s openly admitting that his goal is to seal family court from ANY public scrutiny at all. I can’t wait to see how the Supreme Court rules on those writs. It’s going to be great to see some of the past orders and cases come to light. I know the legal community generally thinks family court is a circus, but the reality is so much worse.
Not all attorneys who practice family law are bad attorneys, but all bad attorneys practice family law. I’ve never run into more nonsense during my 20ish years practicing law than I did in the year or so I was heavily in family law.
I’m licensed in two states and Nevada is the cheaper of the two by about $200. But yeah, screw the bar both wasting money and hoarding cash. What do they need reserves for? The state bar should take what they need every year to cover costs.
Everyone will say that the annual conference MAKES money every year, which is only part of my problem with it. It’s held in far-off places to exclude the masses while the folks who can take a week off and pay several grand for travel and admission get a golden ticket to suck up to judges. If it’s a bar function it should be IN Nevada or no more than a few hours by car from our borders.

In 2022 – Revenue from Annual Meeting was $203k. Expenses for Annual Meeting were $365k. Can’t wait to see the number that come up on the 2023 Annual Report. Now, maybe they make that up in BS CLE, but it calls into question the ethics of the SBN approving CLEs in which they have a significant financial interest.
Also, 29% of revenue, or $2 million goes towards discipline expenses.
Read the Advanced Family Law CLE material. Mr. Willick’s material and presentation are advocacy for his point of view. Shame on the CLE committee for not adding an opposing point of view. I respect all that Marshal does/has done for the Family Law section. This time he is wrong.
I’m not following. What is Marshal arguing for?
He wants pretty much every case in family court to be sealed. He does not want any media or public oversight of what goes on down there. He wrote a brief against the ONJ writs and, no joke, actually wrote that Chester the Molester was going to review custody cases to find out where little Susie gets on the school bus. Not that you can’t just drive around town and see children queuing up to get on school buses every morning, but I digress. Anyways, Marshal even went so far as to claim that he represented one of the litigants in one of the cases that went up. The litigant publicly reported that he did not represent her and she was not his client. Marshal inserts himself into just about every committee associated with family court, including the rules committee. He’s propagated rules that add to the byzantine maze you have to go through to access family court cases, including a blanket sealing of all custody cases. It is prejudicial to pro se litigants, empowers abusers, and allows family court judges and attorneys to operate under veil of secrecy. The only way that place is over going to get better and those judges are ever going to be accountable is if the public and the media is allowed access. Judge wants to give a convicted sex offender custody? Ok then they can answer for it to the voters.
This thread almost induces me to go to He Who Must Not Be Name’s site to see what I’ve been missing.
I just want to complain about the annual dues for the state bar. It is nothing but a lawyer tax that is used to pay for a few people to have a trip to wherever the annual meeting is each year.
You sweet summer child! Not only do our dues pay for BoG to go on their annual boondoggle, but the chair, a few members, and their family members get to go on an all expense paid adventure to next year’s location for a site survey with Ms. Farmer every year. All while they have $6M in the bank. It’s disgusting and needs to change, but last election several newcomers ran for BoG and the same old guard got re-elected. Gotta run and gotta vote if you want to see change.

Wilfong having such young children makes it so much harder, what a shame.
My goodness, these shooting tragedies seem to be increasingly frequent. The first one I can remember was the 1979 event in San Diego; but I’m sure there were others even before that one.
When they’re close to home, they’re worse.
I don’t have a solution, nor do I think there really is one. The best we can do is be helpful and kind. Hug your loved ones and try to stay safe. We’re only passing through this world anyway.
I get where you’re coming from, but holy shit… can we not throw up our hands so easily? The best we can do is WAY more than be helpful and kind. Even if the cat’s out of the bag in America as far as the number of guns, surely there has to be measures we can take to reduce the number of mass shootings (regardless of how you feel about gun control – there’s more we can do in multiple arenas). I, for one, am not yet resigned to telling my kids there’s nothing I can do to protect them from being shot at school and giving them a big hug to make up for it. As lawyers, we’re in a better position to make more change than a lot of people, for god’s sake.
A friend asked for a referral for a transactional attorney (I do litigation and don’t really know who to send people to) for a purchase/sale contract review.
It involves a company in one state, selling a software/service to a governmental entity in Nevada, via a third party in a third state. Amount at issue is over $10M annually. Any firms/attorneys I can recommend? Thanks!

I had an encounter with opposing counsel yesterday that was so bizarre that I believe it is highly probable that OC is experiencing some kind of mental health or substance abuse problem. I do not know this person well, or at all outside of a professional context. What do you suggest I do to help?
Ignore it unless you think s/he is a danger to s/himself or others. I don’t think any good comes from reporting someone during ongoing litigation.
Show them some compassion and ask them if they are OK. If they respond to your overture without grace, then punch them proverbially in the mouth. I had an encounter with an attorney who is a frequent subject on this blog for being less that courteous and who has a documented history of substance abuse issues and tried to show this person some compassion and kindness for what I perceive to be a mental health or substance issue. Maybe it was; maybe it was not and this person is just a jerk. But my kindness was wasted. Does not stop me from at least trying kindness.
My God I just read the female professor shot and killed is a mother of 4. No words for the insanity. I Pray for those children.

So obviously Telles was a nightmare. But anyone who does probate can tell you that the CCPA has gotten no better since Rita Reid took over. Same problems expect nonfeasance under her watch appears to have replaced misfeasance and malfeasance when Telles ran the office.
