- For those of you were anxiously following the Bundy v. BLM “Battle of Bunkerville,” it ended over the weekend with the BLM retreating over concern for its employees’ safety. [RJ]

- Meanwhile, the BLM’s “Free Speech Areas” are sparking some debate. [RJ]
- The disbarred attorney, John Michael Schaefer, who was recently told he can’t run for Nevada State Controller because he didn’t satisfy the residency requirement, is making a fourth attempt at reinstatement to the bar. (He is also appealing the residency requirement.) According to the article, it looks like Justices Gibbons and Cherry are already in his corner. [RJ]

"Trespass cattle" is a misnomer. Nevada, like other Western states, is a "fence-out" state. If the BLM wanted to keep cattle out, they could have constructed a fence at any time, like any private homeowner would need to do. But they have a long history of high-handedness. Hell, the local BLM flatly ignores federal regulations pertaining to access by photographers, charging them "filming fees" or threatening to cite them.
The Supremacy Clause means the BLM is not bound by the State's open range law. Bundy is simply a wing-nut who wants to run his livestock for free. BLM permits are already significantly subsidized by taxpayers, as the cost is far below the market value for grazing rights on private land.
There is no "right" to graze livestock on BLM land, it is a permit, the same as a lease. It amazes me that the crack pot right-wingers have adopted Bundy as their hero. He is a thief who is stealing taxpayer money and then waves the Constitution around like it is his golden ticket to run his cattle for free.
The wing-nuts are praying for someone to get shot.
