Off topic but I read about the OBC persecution of Sarah Hawkins. I knew she had gone through a disciplinary proceeding, but I wasn’t following it and didn’t know the reason. Needless to say, I am completely disgusted at what happened to her. OBC is completely off the rails. They had absolutely no business whatsoever going after to her like that. There is no legal basis for LVMPD to think that they can respond to subpoenas differently based on who issues them.

I was happy to read that Dominic Gentile and his team represented her pro bono, but that’s still completely out of line. It is inexcusable that an attorney would have to hope for pro bono representation or pay for representation in a disciplinary matter based on these facts. I cannot imagine the stress that Hawkins went through during those proceedings. Something needs to be done about OBC. BoG clearly is not going to change anything.

From the Bar minutes: “Generally, the remarks regarded significant concerns from attorneys about the bar complaint against Sarah Hawkins. Most comments indicated a concern that the OBC overreached in this prosecution, seeking to prosecute a matter to resolve an unclear statute, and participants voiced major concerns with how this matter was managed from grievance through hearing.

Outgoing President Cavanaugh-Bill indicated that the Board would receive written comments regarding this matter sent to President@nvbar.org through July 15, 2024. Thereafter, state bar leadership will assess this situation and all information provided, in order to determine next steps.”

Associated topic: Those interested in OBC from a couple days ago are asking wrong questions about the stats. The OBC instigates and deters grievances all the time so they control some of the stats. They also push thorough or detain some that are grievances. There are many ways they manipulate the stats. If they keep hiring like they have been we can expect the same. When one lacks experience and has low self esteem trying to prove something then every problem looks overwhelming, misunderstood, and ripe for discipline.

Absolutely agree! OBC picks and chooses who they are going to go after and they do it with absolute impunity. There is no consistency. The rules are not enforced fairly or equally. It is not a neutral process, but rather subject to the whims of an inexperienced, overzealous egomaniac. If you’re reading this and think they can’t come after you too, think again. What OBC did to Hawkins is indefensible and they will continue to act that way until they are forced to stop.

It is my personal opinion and belief that the Hawking prosecution arose from ulterior motives and was not brought in good faith. I base my opinion and belief on the observations I made during the live stream of the hearings.

Assuming you’re an attorney since this is a law blog, why don’t you use your analytical skills to analyze the policy behind student loans, law school, and bankruptcy. Analyze the cost of college and law school in comparison to the flat line that has become American income. Analyze what the rank failures of the economic policies of the 1970s and 1980s have done to our current economy.

Boomer, maybe, maybe not. What I am is a responsible adult who understands the obligations incurred in signing a contract to borrow money. Notwithstanding the contractual obligations, there is an honesty factor. You want something for nothing, and wish that I pay for it.

I didn’t ask you to pay for shit, boomer. With a law degree, I make more. I pay more taxes. I spend more which generates more jobs, which in turn generates more taxes. But I know anything more than a bumper sticker is too much critical thinking for you. The government should not be charging 8% interest on student loans. You do realize there’s more than a trillion dollars in student loans that are not being paid or are in minimum/income based repayment plans (including those as low as $0/month)? Since you’re an old boomer, surely you remember 2008 when the unregulated mortgage market crashed and the economy went into free fall? So, do you want to be right or in a depression?

Also, I do not now, nor will I ever, drive a BMW. They are pretty and they are fast and I would go to prison for felony reckless. I drive an old car that will not allow me to win street races on I-15.

What part of paying back more than twice the amount borrowed says “deadbeat” to you? It’s almost as if separate anonymous posts can be made by multiple people. The fact is I have faithfully made all of my loan payments (including during COVID when I didn’t have to). I simply stated my opinion that the terms of student loans are onerous. BTW: when you’re choices are to either borrow money to go to school or continue digging ditches the rest of your life, there is nothing impulsive about it. So, by all means, go fuck yourself.

Why are corporate handouts acceptable or military contracts acceptable when they can’t account for a trillion dollars, but handouts for people are not? We gave businesses Covid money and cried about giving it to people. If you hate handouts at least be critical of all handouts.

We don’t charge children or their parents to attend public school. Why not? I mean, think of the billions that are spent in every state that could be going to business development and business owners, right? Fuck public education, let’s get that money to the SBA and get loans out, amirite? They won’t be able to calculate interest rates, but they can pay them!

Or is it possible that a well-educated population is worth investing in? That encouraging people to attend institutes of higher learning provide massive benefits to the economy and the country as a whole? Don’t believe that? Go look at licensed professional surveyors, or accounting, or any of a number of fields where the number of new entrants is not even close to keeping up with the people who are retiring.
