Questions, re: Ubers ballot initiative

1. I’ve heard colleagues say, “Well, this will violate the contracts clause of the Constitution and will be struck down anyway.” I’m not so sure about this. It looks like contingency restrictions in other states have been upheld. Am I missing something?

2. How seriously is NJA taking this? How much money will they put into it? Whenever I speak with my PI brothers and sisters in Christ they seem dismissive. To me, this looks like it is very likely to pass/be enacted.

3. It looks like its just Uber. Am I wrong? Why wouldn’t insurance companies jump on board with this?

4. I wonder if Uber surveyed several states to try this for the first time and picked Nevada. If so, that begs the question, why Nevada? There are two things that immediately come to mind: (1) we’re a small state, so a media campaign is relatively inexpensive; (2) we have a fairly easy ballot initiative process (comparatively speaking). What else am I missing here?

If you are a PI attorney I recommend that you contact the NJA to see how you can get involved.
If you are an ID attorney I recommend that you contact a PI attorney to see how you can help. Because if this passes you are going down, too.

100 percent affects both sides…less cases for PI, means less ID cases to defend and less billables. Then both sides start lessening case loads or potentially close shop.
I see more Uber ballot people than the legal community making noise…so make noise as this is lots of people’s bread and butter…

This is not a bad thing. This will be the Las Vegas Legal market’s industrial revolution. I for one welcome the site of new billboards and maybe some lower insurance rates.

We saw the same thing happen with construction defect. Once the law changed, claims went wayyyyy down. Less work for all sides – P, D, and third party Ds.

Shockingly, this did nothing to reduce the cost of housing.

Exactly. What it did do is lead to shoddier construction and make it harder for homeowners to solve issues.

Plus high rates of accidents with Uber drivers and non-Uber drivers and they retain the PI lawyers…

The NJAs commercial they just put out is absolutely laughable. Seems like the PI industry here is toast to me.

If you’re a family court judge and you think you can delay a custody order after trial for 6 months, you’re delusional. Check the canons and look for a complaint with your name on it.

I feel for you but I clerked there and have seen them take even longer. No effect no sanction no results. They get by with it for some reason.

Probably another Cutter or Perry problem again. Most orders should be able to be done in 2 months.

I finished a trial in February. Judge then allowed the mother to submit additional discovery… didn’t help her and it ended up being stricken. Now Judge has set an additional day of trial in yet another attempt to get evidence to support the falsehoods presented to the court for more than a year. If I Writ or complain it can affect my client. BTW not Perry or Cutter. This is a systemic problem.

my guess as well. She is not qualified to be on the Bench. Could also be Butler or Charter. It truly is horrific how bad the current family court judges are.

Butler tries hard and is at least average. Parlade is more interested in the prestige of being a judge. Charter just sucks.
