I know journalistic integrity is at an all-time low, but Steve Hackett does not represent Clark County School District and he did not make any of the arguments that The Nevada Independent attributes to him. Hackett represented the plaintiffs, CCSD is a defendant. This is pretty basic stuff.

Family Court Judge Bill Henderson has to bear some responsibility for what happened right? Based on prior comments of how contentious things were in that case and between those families, why would you ever allow them to be put in the same room together?? (Obviously I understand they are attorneys and have the “right” to be there — but still).

The entire family court absolutely has to bear some responsibility. That system is rotten. The family law attorneys that were involved in that case bear some responsibility too. Someone recently commented about clerking down there and how the judges would rule in favor of the attorneys they knew. It’s true. They do. All the time. They allow cases to spiral out of control. They allow attorneys and parties to make unsupported allegations all the time and no one is ever held accountable. It’s a broken, abusive system and I’m surprised terrible incidents like this don’t have more often.

In December 2016, Lyudmyla Pyankovska sued her exhusband, Sean Abid, and his attorney, John Jones, in the United States Court for the District of Nevada alleging federal and state wiretap violations as well as various state common law claims. She alleged that during a bitter child custody proceeding in Nevada state court, her ex-husband had secretly recorded conversations between her and their child, and that Jones had filed selectively edited transcripts of the illegally recorded conversations on the court’s public docket.

The panel held that Jones violated the Federal Wiretap Act, and it agreed with the district court that the vicariousconsent doctrine did not apply and that Jones’s conduct was not protected under Bartnicki v. Vopper, 532 U.S. 514 (2001), which carves out a narrow First Amendment exception to the Federal Wiretap Act for matters of public importance. The panel further held, however, that Jones’s conduct was not protected under the Noerr-Pennington doctrine. The panel concluded that Pyankovska’s lawsuit did not impose a burden on petitioning rights because Abid prevailed in the state court custody case, and Jones had no petitioning “right” to use the transcripts. The panel held that filing illegally obtained evidence on a public court docket is conduct not immunized under Noerr-Pennington, and the Federal Wiretap Act unambiguously applied to Jones’s conduct.
The panel held that the district court incorrectly computed statutory damages under the Federal Wiretap Act because it did not consider whether Abid violated the statute for more than 100 days, which would render the amount of damages greater than $10,000. In addition, the district court failed to adequately address other categories of damages to which Pyankovska might be entitled, including punitive damages, attorney’s fees, and damages on Nevada commonlaw claims.

He will never learn his lessons because the family court judges will never hold him accountable for his behavior. Years ago I posted about the outrageous outcome of a case I had against him and one of the commenters accused me of being a disgruntled pro se litigant who did not understand their own case. I completely understood it and the judge’s order was just insanity. She tied herself in knots to let him off the hook for blatant, proven lies to the court. It was sickening then and even more sickening now. I hope every judge in family court knows that they have contributed to this result.

It’s not a matter of being bitter. The discussion was regarding a certain attorney’s behavior and if he’s ever going to learn his lesson. I related the story as a demonstration of my belief that no, he will not learn his lesson. His antics have been going on for decades and they will no doubt continue. I do not think he will learn his lesson in the federal wire tap case and I do not think he will learn his lesson from his role in this week’s events. The judges in family court have an established pattern of not only allowing but also rewarding his bad acts.

11:20. This was a deposition, not a court hearing. Presumably, the court knew nothing about it. In fact, the court had earlier ordered that all child exchanges be at the police station, and that Joe Houston NOT to be present during any of the exchanges. No one had asked for this safeguard, but the court imposed it in an abundance of caution. It’s important to confirm the facts before tossing out the accusation that the judge shares responsibility. for these three horrible deaths.

11:20 here. I completely disagree. If there was an order signed by Henderson that Houston shouldn’t be around during the exchange, and the court SELF IMPOSED IT, he should have had foresight to keep them as far apart as possible. No shot he should have allowed them to be in the same room. Even during depositions.

Henderson shares some responsibility, no matter how you cut it.

@9:38 I agree with your comment, but it goes beyond that. They were dragging in previous spouses, grandparents, etc. The case was spiraling out of control. There were too many family members acting as attorneys. It was getting too heated. The non-family member attorneys involved are not known for reasonableness. The court was being used as a weapon to harass, disparage, and abuse each other. It is the court’s responsibility to stop this kind of behavior, but the reverse happens. Family court is a cesspool.

The point of mentioning an earlier personal negative experience with child custody in Clark County was presumably to posit to the readers whether said negative experience may have played into the motive or feelings of desperation that caused the unspeakable to occur here. At least that was my take. But, you chose to dedicate your time to typing up a comment about something that could be perceived as embarrassing about someone who just lost their life to inexcusable violence. I think Joe Houston, knowing that he was soon to die, would no longer be able to represent Dylan in what appears to be endless custody battles for the next 15+ years. He also knew Dylan would also probably have to hire outside counsel for the same period. The rest is history.

Some of these comments sicken me and reflect the small lives the posters must have. Lawyers that make more and travel in certain circles aren’t bigger and better. What’s wrong with you. Some of focus on our Religion or family or pro bono work. Believe or not it doesn’t make any difference but I wouldn’t spend a day of my life chasing money or fame. It’s a fool’s errand.

This has been a tough week. It’s hard to just keep going about things as if everything is normal. It’s not. Someone we know killed someone else we know in a situation we all find ourselves in on a regular basis. I have such mixed feelings about it all. I had cases with Dennis and none of them were a pleasant experience, but I know he was doing his job the way he thought he had too. I know there were extra layers to this situation, but I can’t help but think about the times I’ve pushed a little harder in a deposition and upset someone. It’s my job, but scary to think that this is one potential outcome. It’s unreal to think about someone being across the conference room table from you doing this. I really feel for Shannon and Lisa and the others in the room. I have no doubt they’ll carry on at some point, but it’s not going to be easy. I hope that our legal community will learn from this. I know it’s unlikely that everyone will, but I have to hold on to that hope that things can change and people can do better.
