But the law is clearly intended to prevent an elected official from appointing a relative to position who the elected official has the power to appoint. For example, if the elected governor appointed his brother has, the chair of an important commission. That’s not this case. The DA has no power to appoint the municipal court. Judge, it’s another elected position. Campaigning for his daughter is not even close to the type of conduct which this law was intended to prohibit.
Indiana judge is wrong. A sandwich requires ingredients between two pieces of leavened bread (or “sandwiched between” if you will). Burrito, wrap, taco involve ingredients enveloped by unleavened bread. How the judge could not see the difference is baffling.
