The irony in the prosecutor secrecy article is that they refer to the DA's "Open File Policy," as the current practice at the DA's Office. Under the "Open File Policy" defense attorneys were entitled to review the DA's file to determine if the DA had items that were not disclosed in discovery. It essentially served as a check at least on the DA, if not police. Apparently, that policy was abrogated when DA Wolfson took office – WITHOUT NOTICE to the public any of the defense attorneys, who have continued to rely on the decades of established practice. Now, defense attorneys must just hope and pray that they get the information when even police admit the entire system is broken. Lovely.

Wolfson might be the DA, but I've never had a problem looking at a DA's file. I'm sure some of the newbies might be on board with that craziness, but with a few exceptions, the DA's aren't going to hide shit. Most are solid people and they're not trying to hide the ball. The thing I love about crim is that we all get along… at the state level. Feds don't count, they're fucking crazy and aren't giving up shit.
@2:08 You hit the head on that nail. State level is professional and courteous. Feds are the most corrupt, crazy, power-hungry, cheating group that you will ever encounter. But its the product of the system. Power corrupts. The absolute power of an AUSA corrupts absolutely.
The Older DAs that were around when Rogers was around are good DAs. The newer don't have a clue. Come on, Dustin Marcello and Trevor Hayes were briefly DAs, what a joke.

Dustin works for one of the best, Pitaro, and his last two jury trials that he personally has done have been not guilty. I'd say he's done better than most. Also, he was a clerk with the DA's office, he was never a DA. He is a bit of a nut, but he's not functionally retarded.

The curve on this study makes me question its objectivity. One C is the highest grade? California is second with a C-? That is not to say the state can't improve — there is great room for that — but this curve sounds like more than it is b/c most people just go straight to the grade and assume at least some As or Bs but in this study there were none.
Why call out Dustin? He's had great success and has always given me good advise when a criminal matter comes up in a civil case.

Disagree with the Dustin Marcello haters. He's had some NGs in multi-felony trials this year. He works with Tom Pitaro and Tom does not suffer those who suck.
Those are Pitaro wins, not Dustin's.

I think Dustin deserves credit for verdicts in trials in which Pitaro does not participate, such as the two acquittals mentioned above.
