Department 3 Election Guide

  • Law

District Court Department 3 features a sitting judge, Douglas W. Herndon, versus a perennial candidate, Michael D. Davidson. You can get more information at edjudicateclarkcounty.com or Vote411. If you want a reminder of how Herndon faired in Judging the Judges, 81% said he should be retained and he had 5 peremptory challenges. Is it time for Herndon to go or does he deserve another six years on the bench in Department 3?

Who should be elected in Department 3?

It's Herndon. Not even close. Dude may be the best judge in Nevada.

You are crazy. Herndon sucks in civil cases.

All I do is civil practice. Judge Herndon is amazing. Practically has the papers memorized before the hearing.

I know nothing about Davidson, but I am not a fan of Herndon. While he appears to be relatively smart, he fancies himself as being an "intellectual" and he wears his self-anointed "intellectualism" on his sleeve. I have observed some rather bizarre rulings from him in the civil arena, on matters ranging from purely issues of law to evidentiary issues. I would rate him in the upper 50% of the district court judges in Clark County and possibly estimate him as barely breaking into the upper 1/3, but that is a very low bar.

He is far from the “best judge in the state”, but I have no doubt he believes that to be the case.

I'm voting for Herndon, but he's made a few moves in the past few years that have caused me to lose confidence in him. And I'm a civil attorney so I'm not really counting his self-righteous recusal of David Schubert – after publicly commenting that the plea deal was too lenient (I know others will disagree). Either recuse or reject the plea if that's how you feel. Regardless, his decisions in a few civil matters, have simply been unsupported by law lately (I even won one of them, but for the wrong reason).

Regardless, I still think Herndon is generally fair and is intelligent when he applies himself (which is most of the time), but, like Judge Gonzalez, I think he's getting a touch of the black robe disease. Hope he (and Betsy) returns to form. Lots of parenthesis here. Sorry.

Anyway, why did Davidson, who seems to run frequently, choose to run against Herndon? Was he upset with a ruling and wanted to be placed on Herndon's automatic recusal list? I don't know how good of a judge Davidson could be, but he certainly would have had a better chance in another dept.

I'm looking forward to when I retire and don't have to kiss judge ass anymore, and I can just shoot from the hip and openly criticize "judges" to their faces. That might help temper the black robe syndrome.

I am supporting Judge Herndon. I have known Mike Davidson for over 15 years and believe he would be a good judicial candidate in a future election, but my scale clearly tips in favor of Judge Herndon in this race.

Herndon. It is a shame Davidson didn't run in another department but why give up a solid judge? I'd have voted for Davidson if he'd run elsewhere, depending.

Please tell us why it is a shame Davidson is not on the bench. Why is he so awesome? Does he even practice law anymore? Was/is he any good at it? Why hasn't he won in the previous four or so races? Didn't he have a high-ranking position at the DA's office at one point? That usually is a golden ticket to the bench. What went wrong?

Davidson would not be a solid judge, in my opinion. He is the constant perennial candidate, which lose my vote right there. I have met him, and I think he is pushy. Some big jerks are over at Kolesar, him being one of them.
