I am not hardly a member of the NJA; but I cannot help but see its efforts in this construction defect legislative battle as heroic. NJA members are putting in time, effort, and a lot of money to crank up CD machine again. Yes, they'll benefit greatly once the old "Chapter 40" system is restored; but look at all the others who will benefit: donut-eating insurance defense lawyers, court reporters, claims adjusters, construction "experts", document management companies, mediators, special masters, paralegals, and on and on. And none of these derivative beneficiaries are contributing to the effort to bring back the old system. Trial lawyers are not heroes for the pretextual reasons they say they are; but they're heroes nonetheless.

And if you think CD isn't great for the legal industry, just wait until some out-of-work insurance defense lawyer comes looking to take YOUR job!

Couple of points you got wrong or mischaracterize–

donut-eating insurance defense lawyers- Those plaintiffs' counsel ate donuts too. And it is a little disingenuous to say that the insurance defense lawyers are not lobbying to bring back the old system to the detriment of their clients and their carriers. The construction industry is lobbying and is using lawyers. Both sides are using lawyers.

claims adjusters– Yes absolutely why wouldn't claims adjusters be up there advocating for more insurance money to have to be spent? How "unheroic" of them.

mediators– Mediators of course. Their neutrality would never be questioned if they lobbied the Legislature for more money floating to be given to Plaintiffs.

What you have just described is not heroic; it is self-interested pablum. Heroic is if you said trial lawyers were standing up for the little guy and trying to write the wrongs and get justice. Everything you just said represented what was wrong with the old system– Scott Canepa got rich, Nancy Quon suffered and builders went broke.

And if you think CD isn't great for the legal industry, just wait until some out-of-work insurance defense lawyer comes looking to take YOUR job!

Ya know, I was a CD lawyer for a few years, and I don't recall eating that many donuts. Cookies, yes. Taco Tuesday at Esquire, sure. Whatever mystery meat was the alternative to the vegetarian meal at Lit Services, absolutely. Occasionally, if we were lucky, Panda Express. But donuts? Maybe that was just before my time.

Donuts are wonderful, but they are stale by the next day. Perhaps twinkies, and other Hostess products, are the protected class as they are so saturated with preservatives that you can enjoy them months after purchase. Well…your mouth and taste buds may enjoy them…but your heart, arteries and other organs? That's a different matter altogether. But Twinkies are the true protected class among pastries.

Remember when they were going to be discontinued a few years back? But the public hue and cry saved the Twinkies form their pending execution date.

There were some abuses by the plaintiff's bar under the old law, but the 2015 revision was a wish list for builders that went way too far in the other direction. They need to bring it back to the middle somewhere, and I say this as one who has eaten many cookies on both sides of the table.

I've been opposite them on a few cases. A couple of people were decent to deal with, a couple of others were real assholes (one of whom is well-known as such around town). My guess is they're probably no better or worse than many of the other multi-office ID sweatshops that have sprouted in the last several years.
