I really appreciated Figler’s thoughts on the judicial election: https://substack.com/home/post/p-220034462

After reading his list and explanations, I feel like sponsoring a podcast for him. “Hi, welcome to Terrible Takes with Dayvid Figler. Tonight’s episode: ‘Why Jake Gyllenhaal’s Roadhouse Deserves Best Picture and a Posthumous Apology from Patrick Swayze.'”

This guy is a hack. Bluth, Talim, and Mendoza described as “Da in a robe” and “hardcore DAs who only got worse with power.” Sorry they hold people accountable and aren’t soft on crime. I’d say those three are pretty good judges. Not just in criminal but in civil, too. Good company.

Also, Tracy Hibbetts spent more time as a PD than she’s been a DA. Don’t know how that equates to her lacking diversity of perspective.

How much weight does the Culinary slate have in these judicial races?

Probably more than other recommendations but, in the end, not all that much.

Not sure, but even his own campaign manager left him off his “picks” list. That speaks volumes.

He’s had a different campaign manager for a while now, that’s why he’s not on the list. Tom’s a pay-to-play service.

I’m a little late to this it seems, but two parts of Figler’s analysis bear some unpacking. 1) If he was talking about say Herndon or Kephart, “First Amendment and demeanor issues” would’ve resulted in Figler calling for their heads on a pike. 2) A prosecutor that strikes “terror” into criminal defense attorney Dayvid Figler’s heart sounds like more like an endorsement than a criticism. Just my two cents.

Re: Nevada Independent insert

Not a single civil or business litigator who regularly practices in Nevada state court appears to be represented on that panel.

Steve Wolfson — District Attorney (Criminal law)
Nancy Lemcke — Public Defender (Criminal law)
Dayvid Figler (Criminal law)
David Westbrook (Criminal law)
Caleb Green (Intellectual property. He is intelligent and hardworking, but if/when he does appear in court, his practice is primarily in federal court.)
Bailey Bortolin (Public interest coordinator)
Ed Kainen (Family law)
Africa Sanchez (Family law and immigration)

A substantial portion of the litigation conducted in Nevada state courts involves civil and business disputes. The absence of attorneys who regularly handle these matters raises serious questions about whether this panel has the practical experience and local knowledge necessary to evaluate issues affecting the bench.

Boyd School of Law should not be entrusted with overseeing these matters. Faculty lack of familiarity with the local judicial climate and the realities of civil and commercial litigation in Nevada state courts is apparent. The availability of free law student labor is no substitute for the practical experience of attorneys who regularly litigate in these courts.

And, if Boyd is once again relying on tuition-paying law students to provide unpaid labor for this initiative, those students should be given an honest assessment of the educational value of their participation. Unless the exercise provides demonstrable practical experience, meaningful professional development, or other tangible benefits, it is fair to question what, if anything, the students gain from their involvement.

I wonder what TNI’s response to this would be? Leaving nearly all different kinds of civil litigation off the panel is a pretty egregious error. There has to be something we are missing or don’t know.

Their panel was even worse last election cycle if you can believe it. This was their attempt to get more perspectives. Ha.

Yes, identity matters in diversity. If everyone is the same, then there is not diversity.

I like the Indy and know that I am in a minority in that I like Ralston. But this panel is egregriously bad. Ed Kainen is a fair source for Family Court but Caleb Green and Africa Sanchez cannot be the sources for civil bench. However the lack of meaningful civil practitioners (and inclusion of someone who is the spouse of one of the candidates and never appears in court) is frankly shocking.

TNI: “although there was some thought by other judges that he has a streak of misogyny.”

Misogyny is not just a bias. It is “hatred of, aversion to, or prejudice against women” https://www.merriam-webster.com/dictionary/misogyny

It is stunning that TNI and the panelists would so casually throw that serious accusation around, particularly without any objective act or incident to rely on. Embarrassing for the panelists and TNI, especially where the opponent is one of the panelists spouses. Awful.

Just throwing this out there. Few people understand the difference between sexism and misogyny, and use the terms interchangeably. Sexism is a set of beliefs and stereotypes that justify gender inequality by presenting traditional gender roles as natural or appropriate. Benevolent sexism is a form of sexism that appears positive or protective, portraying women as caring, pure, or deserving of protection, but reinforces restrictive gender roles and unequal power relations. Although it may seem complimentary, benevolent sexism can limit women’s independence and opportunities by rewarding conformity, while women who resist traditional expectations may face criticism, exclusion, or hostility. Misogyny involves punishing or policing women who challenge gendered expectations—and that doesn’t require believing that women are inferior on an intellectual level. Misogyny just requires the desire to dominate women.

While I can’t know for sure what the panelist’s experience was, I suspect the panelist was referring to benevolent sexism not really misogyny.

Well, words actually mean things. And the word they used was misogyny, a word that connotes aggressive hostility and contempt for women. It’s a very serious accusation made by people (journalists and lawyers) who use words for a living. Given the gravity of the accusation, my benefit of the doubt goes to the unfairly accused, not the accusers.

They said it more concisely, he’s viewed as a political creature (i.e. republican that Hutch promoted) and therefore bad. He’s also mormon and, perhaps justifiably so, must think poorly of women.

If you have evidence that he is misogynistic cite it, don’t take this cowardly way out by saying “some judges say” or “he’s mormon” so maybe? Bluth, Leavitt, and Hardy all are or were Mormon at some point. Are they misogynists too? Wait til you hear about all the sexist doctrines in Judaism or Catholicism. I hope those will be similarly disqualifying for future candidates based on the same rationale.

I’m telling you what the likely source of the bias is (I would say the same thing about many hyper christians too). But I agree 100% that the fact the Independent says it without any relationship back to a basis is irresponsible at best.

TNI is the most ironically named news source in the world – independent, as long as that means democratic, leftist, and supportive of Ralston’s ego. Ugh. We get it already, you hate DA’s, LDS, men, civil attorneys, the GOP, and won’t pass up a chance to unfairly smear someone. Independent, indeed lol

Duane “Keffe D” Davis, convicted of Tupac Shakur’s killing in 1996, has been sentenced to 40 years to life in prison. The sentence includes a 20-year mandatory enhancement for profiting off the murder, Judge Carli Kierny told the court.
