Thanksgiving 2023

We hope you all have a safe and happy Thanksgiving. Please be smart and don’t drink and drive. If any of you are struggling with life, please don’t give up. There are people that care about you and people that can help. There are more people going through stuff like you are than you can possibly imagine. You don’t have to do it alone.

What are you all grateful for this year? As always, we’re grateful for you. The blog is pointless without you reading, commenting, and making suggestions. Thanks for being part of it!

I’m thankful that this year I finally was proactive with my mental health and burnout. Found a therapist, received treatment for my anxiety, and accepted that I don’t need to work myself to death to be a good lawyer.

Mental health is so important. It would also help if some attorneys weren’t so uncivil with each other.

Long story short I made a lot of sacrifices, left NV, and obtained a new specialized degree that leads to a licensed career. I’m 1000% more happy.

This is absurd and absurdly heavy handed. We saw what the public thought about trying to prohibit transitory peeking at the F1 events from these elevated public sidewalks. There’s no reason to make being a pedestrian-tourist a crime.

This holiday, as in past holidays of this kind, I’m thankful that I have only about a month to feel guilty about not fulfilling my 2023 New Year’s resolutions. Soon, I’ll have fresh resolutions to make and inevitably ignore.

Practice questions:
If a case is stayed due to a party filing BK, does that toll the five year rule?
Also, is any time added to the five year rule as a result of the tolling from covid?

Edwards v. Ghandour, 123 Nev. 105, 159 P.3d 1086 (2007). The Rule 41(e) 5-year period is tolled only as to actions against a debtor in bankruptcy. The deadline is not tolled for nondebtor co-parties or as to actions brought by a debtor.

Except the statute is also tolled as to co-debtor non-parties, as well.

Co-debtor parties, yes. I’m not sure I follow as to co-debtor non-parties, as tolling which would apply to a non-party would have no effect on the parties to the tolled litigation. See Edwards n.14: We note our disagreement with Edwards’ contention on appeal that a nonparty’s bankruptcy filing also tolled NRCP 41(e)’s five-year period. Not only is Edwards’ assertion contrary to his district court position that “the bankruptcy of a nonparty to this case has no bearing on this case whatsoever,” the automatic stay associated with a nonparty’s bankruptcy filing generally has no impact on the parties to an action. See 11 U.S.C. § 362(a)(1) (stating that the automatic stay applies to actions “against the debtor”).

Under the Covid regulations cases were rolled 121 days if I recall correctly.

I wouldn’t think the COVID tolling would stack with any bankruptcy automatic stay tolling. Tolling is either in effect for one reason, the other, or both, but you don’t get double time if both reasons for tolling apply.
