That Petition for Review filed by Evan Schwab against the LDS temple is a hot mess. Oof. It could have used a proof read or two. Or five. It’s *very* hard to read. Is he going to have to amend that to clean it up?

Every time I’ve had a case in the news, I devolve into paranoia and proof read every filing like 80 times. I can’t imagine filing something like that ever, but where it’s going to receive so much public scrutiny?

That petition is giving me some heavy fremdscham.

I don’t practice in the area of judicial review of public/city decisions. Is there a requirement that the petition be verified via sworn declaration or affidavit?

I looked at NRS 278 and I don’t see any requirement for a sworn declaration from the client. If it isn’t necessary, this was a huge screwup because the stuff thats alleged in the petition is crazy and baseless. Kaempfer Crowell didn’t funnel bribes to the City Council. Good gravy.

You raise a great question about what KC will do in response. These allegations didn’t first appear in the Petition, they’ve been circulated by Mormonish podcast and other opponents for quite some time now. I don’t think KC would bring a defamation action, but maybe I’m wrong?

I am certain the Church will not bring a defamation action on the bribery actions. I do wonder whether the Church would be willing to pursue an award of attorneys fees. Probably not, but maybe.

I just looked up the Petitioner – Nevada Rurual Preservation Alliance, and it looks like it was formed after the city made its decision. Anyone with knowledge of these matters know if that divests this entity of standing to petition?

I wonder that too. Can anyone weigh in on the standing issue? My gut says that as long as a resident within a certain proximity to the temple is a member, they have standing regardless of when the entity was created. But I don’t actually know the answer.

Used to carry the minimums, because, well, poor, cheap, and the cars weren’t worth shit anyway. Then I worked for ID firms. That caused me to bump up my liability and make sure I had UIM, because nothing will screw you over harder than a long hospitalization caused by someone who doesn’t own anything and carries the minimums, if they are insured at all. Throw on an umbrella + homesteading, and I sleep better at night.

Just add the umbrella policy. It covers everything above the auto policy. I would not worry about upping those limits, unless you have teenage drivers in the house.

When I had teenage drivers I carried 250/500/100 with a $5M umbrella. Auto policy only got popped once through 4 kids.

Yes. My insurance carrier (AAA) requires that your home and auto be insured with them to add the umbrella. They also require higher limits on auto before adding the umbrella.

Call the Broker that writes your Professional Liability insurance for starters if you have a relationship. Or see if your auto carrier has the option to add an umbrella policy. Some do.

Make sure to purchase an unbrella which also afford excess UM/UIM in the same amount as the umbrella coverage.

I’ve actually tried to go heavy on Med Pay when possible. Having represented ID carriers i find there to be a lot less scrutiny on getting that paid than UIM can have on occasion.

I have State Farm. The umbrella is so expensive. The UM/UIM is a killer. They don’t write it any more. Who is the best for an umbrella. I only have 1 million not enough. Where to go to get more. If I drop UM/UIM with State Farm I lose it. They are basically making it too expensive to have. I need more liability insurance protection with an umbrella. Can I get it from another carrier cheaper than State Farm. Is anybody writing UM/UIM. I hear stories of people switching only to get dropped or getting huge bump ups in premiums after they switched and stayed on for a year.

Rules now require disclosure of policy limits immediately upon request. Smart shops might then tailor the treatment to match the policy. A doctor might know about the policy amount and treat accordingly.

Rules have always required that. Not sure an umbrella policy applies to that.

However, the thorough PI shops make you sign (when settling) a declaration that states that there is no other insurance.

The mining companies will out spend them and tie the state up in federal litigation for years. The reality is that as long as our politicians (federal, state, and local) continue to bow to corporate interests, our communities are going to suffer. Reid protected NV mining companies for decades in Washington. Corporations are NOT suffering. They are posting record profits and price gouging us while we yell at each other about inflation. Nevada is not a sustainable environment, but Clark County does nothing to curb development. There are still new houses being built every day. Lake Mead gets emptier and emptier. I don’t have the answers, but I know Las Vegas is not part of my long term plan.

Doubtful, but Maybe. Regardless every new development will require more water. Also, there is significant evaporative loss from not only lawns, trees golf courses, and pools. For example, I have a somewhat large pool and I lose about 1″ every week to evaporation.

We are have to find another source or stop development.

PS: Before some gun slinger starts snipping, please note that my pool was built at a time when nobody was concerned about water.

There was a venire of 60 prospective jurors in the courtroom, maybe 30 or all 60 at a time. Given the size and layout of the courtroom, it’s difficult to supply any meaningful video of the proceedings, the judge, the attorneys, and the defendant without also inadvertently showing prospective jurors’ faces. So the solution was apparently no video during jury selection. Now that there’s an empaneled jury, there’s less risk of showing the jury because they’ll all be in the jury box and the camera angles will be better.
