What I don’t understand, is the venom, anger and malice from the Trump people, including the various government attorneys. Where is this coming from? It’s definitely not staged. It’s this very potent feeling of victimhood, resentment and vengeance. What has caused so many people to feel so bitter and angry? I am a litigator, and no stranger to conflict emotions that come in our line of work, but I’ve never felt such deep and sustained animus towards anyone ever. Sure, there are people I don’t like, people that I find obnoxious, people that I don’t trust, people that frustrate me, but it doesn’t consume me and I just keep moving through life. This MAGA shit is on a whole different level.

I count myself as one to whom u refer. For me, it wasn’t the political items like budget debates etc but when I felt what I value most was being attacked. Not to debate this topic but to give u an honest answer. My kids go to ccsd and the whole trans issue. I’ll be in court all day so any insults will not be read. Just trying to give op an honest insight.

When you see Trump administration attorneys acting with subservient malice, do you feel validated? Do you feel less angry, more angry or about the same? If the government attorney malice isn’t related to the issue you raised (trans in CCSD), does that effect how you perceive and experience these malicious acts? How much aggression will be enough that you feel like its enough?

I’m back. I feel worse actually. I feel like everyone is fighting and not helping me. Maybe bc I’m a lawyer but I feel as bad when judicial system goes against anyone unfairly. I think the cases re Trump were politically motivated but I think the same way now in current climate. Anyway truly wish good for all and any lessening of jud branch hurts all.

Real question. You felt like what you value most was being attacked? What was that? Religion? I don’t think the Biden administration attacked that. In fact, Biden went to church just about every week. Trump doesn’t. Instead, his security sets off smoke bombs in the public streets so Trump can take a photo holding the Bible, which he obviously holds so sacred. Second amendment? Guns are pretty darn easy to get. I bought one during the Biden administration and couldn’t believe how easy it was. First amendment? Were you afraid to congregate at church? Concerned about the Woke Mob curtailing your free speech? That doesn’t seem like it was a problem. But maybe now it is. Let’s ban books! Let’s issue executive orders to penalize law firms for representing democrats and changing geography because the Gulf of Mexico identified as the Gulf of America!

Anyway, my three kids go to CCSD–youngest is in fifth grade and the oldest is a senior. What is this “whole trans issue” you speak of? Was it discussed in public schools, where Trans students exist? That group amounts to LESS THAN ONE PERCENT of the population. Why did it become such an issue? Because Donald and the mob want to bully vulnerable groups that “scare” them. Why do we lose our minds over this? Why can’t we explain this to our kids? Trans people exist. Go talk to one. I’m pretty darn sure that a human who does something like, oh let’s say a full gender transition, does not do that on a whim or to be a rebel. Maybe a little respect and empathy would help. Oh wait, the “fundamental weakness of Western civilization is empathy,” according to Elon! Look it up.

Instead let’s put on a full-court press of bullying and demeaning them because…Sports? There are about 500,000 NCAA athletes. The NCAA president testified before Congress in 2024. He claimed there were ten…TEN transgender athletes he was aware of. And it’s pretty darn hard to be a trans athlete and fly under the radar.

But this is what Trump and his sympathizers have done for decades. Bully any “others” and silence criticism. I mean seriously, the DOJ should be sanctioned for pursuing the birthright citizenship suit. WTF kind of Executive Order is that?! Then, team Trump goes and has masked agents detain college students who are legally in the U.S. and then send them away with no due process. Sending purported Venezualans to El Salvador to rot in a “prison” that’s more like a concentration camp. Don’t believe me? Look at the videos and read about the prison. No due process, no real effort to be accurate, possibly a violation of the court’s order, and don’t forget, the purported Venezualans were sent to El Salvador! But Kristi Noem used it as a great photo op! Standing in front of starving brown people with loin cloths, crammed into cells where they can barely move. But don’t worry, she looked nice with her Rolex, injections, etc.

How about executive orders directed at individual law firms? How about Johnson, Elon and Trump just deciding that we probably don’t need a judiciary because they’re getting in the way of his “mandate” to do whatever the hell he wants because he’s an authoritarian! (How many nationwide injunctions did Biden’s executive orders get? A helluva lot.) But how dare that happen to Leader Trump! So, NO, this is not a “both sides” scenario.

Who are Trump’s international buddies? Erdogan, Putin, Kim Jong Un, etc. (Or at least Trump think’s they are his friends.) Awesome! The USA is going to make Canada the 51st state. The USA is going to, by hook or by crook, take Greenland from Denmark! Let’s take the Panama Canal as well and go full IMPERIALISM! Hooray! Everyone follow Elon and emphatically make the Nazi salute! Seig Heil! Or am I mistaken–was that the Roman salute? Oh, then no big deal. People always use the Roman salute.

Well, at least we won’t have to worry about trans stuff. I feel better and safer.

The resentment stems from the idea that the left is trying to fundamentally reshape this country into something very different then it has been. I know enough about the practice of law in Nevada to know the idea of Nevada trying to get some of the business litigation case is a horrible idea. Does anyone believe the Nevada judiciary (trial courts, court of appeals, and Supreme Court) is up to the task?

I understand that Delaware has a special court for corporate matters, not civil litigation as we know it, but for things like shareholder disputes. If we follow that approach, district court judges would never hear these cases.

Read a few Delaware Chancery opinions and look at the Delaware Chancellor and Vice Chancellor bios. Then spend a few hours in the 8thJD Business Court. No, the Nevada judiciary is likely not up to the task.

Here’s my question: might this might be doable, if litigants make use of the ability to conduct private trials? I remember when the SCONV adopted the rule allowing private trials, but I haven’t seen many cases of that sort. Thoughts anyone?

I’m not sure what rule you’re referring to, but only privately funded arbitration should be private imo. If you make use of the tax funded courthouse, generally, it should be open to the public (subject to carveouts for victims, minors, etc.)

The problem with this proposal is that it will require a constitutional amendment in which voters would have to vote to disenfranchise themselves from choosing judges. Nevada voters will never approve taking their ability to screw up the judiciary away from themselves.

OK, took a little digging but I found it. ADKT No. 447, and the public hearing on June 7th, 2010. The court established private trials. Obviously it didn’t become very popular. I spoke at the hearing at the time and it was at about the same time that Delaware had adopted new provisions to streamline business trials in their Chancery Division. I had hope that private trials would give Nevada an edge that Delaware didn’t have.

The new procedure allowed for private jury trials; I can’t say for certain if in the meantime private bench trials have been permitted, although I did suggest that in my testimony.

If you note in Rule 3 of the NATR, the judges are to be pro tem seniors and paid for by the litigants, along with all other court costs. It does appear my first comment was in error on one point, bench trials are permitted.

While the phrase “alternate” trial rather than “private” trial is cited, the substance of the rule would seem to be to provide for trials that do not take up the time of sitting judges, nor any funds from the public purse.

Well, the NATR states pretty clearly that the proceedings must be open to the public. I believe secrecy was a key feature of the Star Chamber, so perhaps that’s not really an issue. I’m no expert, so what say you all?

I do not want to “what-about” on this issue because I completely agree with you that Chattah is not only not qualified to run the office but has traits that would otherwise be disqualifying for what is such an important post.

With that said, our previous US Attorney was Jason Frierson whose credentials for the US Attorneys Office were that he had been Speaker of the Assembly and various (unremarkable) stints bouncing between the Clark County District Attorney’s Office, the Attorney General’s Office and the Clark County Public Defender’s Office.

I don’t believe you. In one of my cases she ignored discovery requests and court orders and then sent a contract attorney to get yelled at by the judge, who dismissed her case. In another she did not seem to understand the case at all and would check with her clients during arguments to come up with answers to the judge’s questions. In one argument, she made admissions that made her case unwinnable because she did not seem to understand the law. One time, after blowing the RFA response deadline, she sent over responses that simply denied everything, even things she alleged in the complaint. She was actually pleasant enough. But she did not seem like a full time lawyer. She seemed like someone that was working half time and throwing things together haphazard at the last minute.

And I want to make clear that nothing I wrote above is political. I voted for Trump over Kamala. And while I am a registered independent, for the last few years I have voted for more Republicans than Democrats.
