To the folks that were upset with the term insurrection on yesterday’s blog – whether they were trying to overturn the election or just a big group that got a little overly excited and entered federal buildings and got a little violent (and deadly) and delayed a congressional meeting, do you think these people committed crimes? If your argument is that the statutes used to prosecute them were inapplicable or unconstitutional, do you think it should be a crime in the future for people with and without weapons to protest to the extent that it interferes with a congressional proceeding?
Would you take the same position in the inverse? If the “protestors” were all dei lgbtq acab blm folk (some have guns, some do not, a few people including LEOs die) delaying/obstructing a republican from becoming president. If our statutes don’t allow prosecution of this activity, I think we need better legislation. But do you Jan-6-was-nothing people feel it would still be free speech and much to do about nothing?

Yes. As a dedicated right wing nutjob, I am of the opinion that left or right, what happened that day was NOT an insurrection.

The only criminals from that place on that day are law enforcement (not all of them, just the shooters and the “incognito” feds that incited the violence).

As a left wing nutjob, I don’t think the people attacking the capitol was an insurrection. They were trying to stop the counting of the votes (or hang Pence for not doing what Trump wanted).

The insurrection was Trump’s plan (written in a memo by his lawyer John Eastman) to use the fake ballots submitted to throw out the votes from the 7 swing states, which would leave Trump with a 232-222 electoral vote victory for Trump. And if the democrats in congress complained, then they would cite the 12th amendment that no candidate reached 270 electoral votes, and the vote goes to the states – each state gets one vote. And because Republicans controlled 26 states, they would elect Trump that way.

I’m just pissed that the democrats fucked up the messaging and focused on the people attacking the capitol (shocker, democrats not messaging well), rather than the guy who criminally conspired to overturn an election.

There is nothing in this world I hate more than the condescending rhetorical game about the distinction between a democracy and a constitutional republic. Believe it or not, we all know the difference. In common usage, “constitutional republic” is a subset of “democracy.” Save your pedantic, Kruger-Dunning lecture for 4 year olds please.

By definition, a republic is a representative form of government that is ruled according to a charter, or constitution, and a democracy is a government that is ruled according to the will of the majority. Although these forms of government are often confused, they are quite different.

Yes, they committed a crime. Prosecute for the crime committed. But the videos that most of you saw were the most salacious acts committed only by a portion of the mob. There are other videos, that show the majority peacefully walking through the building. And yes, they also committed the crime of trespass. But it was far, far from an insurrection.

An acquaintance passed away. Las Vegas resident. She has a simple will, no spouse, no kids. Out-of-state sister-in-law is nominated as sole Executrix. Out-of-state niece is sole beneficiary. Assets: a house, a car.

I don’t do probate, and certainly not a sale of real estate through the probate court. Recommendations for a probate attorney?

$35 an hour is $70,000 a year (based on a 2000 hour year) for a person one year out of college for a part time job in which you are giving them training and experience. Seems more than reasonable.

$30-35 per hour. 1L Law Clerk does not further your business in any way, you cannot bill them, they are pure overhead, and cannot do anywhere near as much as a paralegal can. It is, at best, a training opportunity and a career enhancer for the 1L – so what value do they bring to you that you have to pay them more than a paralegal?
