The Nevada Legislature is ADHD personified. Don’t do anything for months and months, then activate deadline mode and get everything done in a couple of weeks right before the deadline.

What else would you have them do? They’re handcuffed to a 120-day session every two years.

Not judging, just pointing out this is the practical effect of having a short session ever other year.

I see a lot of PDs who are up there for this session – do you guys just to take a break from lawyering and move to Carson City for a few weeks?

Is Key Insurance going out of business in Nevada? Client had accident in early February, and I received one call from adjuster. I have never been able to reach adjuster since and today I was was cut off 4 times when I tried to call adjuster at her direct number. When I called the main claims number, they said do not expect the adjuster to call you for 2 or 3 days.

I did work for Key once upon a time and it was also normal as their own counsel.

There is a reason why they have many excess judgments and bad faith claims. They recently fired their entire in-house counsel office here. I believe that Phil Goodhart and Kevin Diamond now do the majority of their work. They are both very capable, but things can be pretty effed up by the time they see the file. (This is not Phil or Kevin writing, btw).

Kevin has been known to be exactly what Key is looking for which is an attorney who is difficult to deal with.

Question: 18 year old drives car with parent’s permission in Nevada. Gets in accident (not his fault) with car that leaves the scene and cannot be located. Car is severely damaged and/or totaled. Insurance company refuses to pay for repairs because 18 year old not a listed driver on the policy. What are the best arguments for coverage of property damage?

Does the policy not cover drivers and vehicles? Do they not have UM/UIM?

Bust out the ol’ policy documents and look at the definition of a “covered driver.”

Family purpose/family use doctrine would provide coverage if member of the family household and known to carrier. They try to exclude. Common in Mexican community where households are large and have many permissive drivers. Usually insurance goes up when a family has a member who is eligible to drive or has a license.

This isn’t a liability claim against a teen driver with questionable insurance. This is a first party comprehensive / um/uim claim.

So Queensridge HOA, one of the wealthiest HOAs in Nevada, sues to stop Badlands from developing to protect their comparable values, but then communized their tremendous loss onto the backs of every real property taxpayer in Nevada. Does that sum up the Badlands case?
