The real story is another charge against the attorney. Aside from Graham, is there any precedent for lawyers facing charges like this?

The Paddock Probate Estate Report was to be filed in January…nothing filed, status hearing on report gets kicked per a stipulation and order … (not yet docketed)…its been four months and nothing has been done to secure or locate assets… who is in control? Is there a new lack of transparency issue? Anyone know anything? Thoughts?

Is/was anyone else frantically completing CLE's this week? No, just me? Ok. In theory, lawyers need to keep up on their education, no doubt. In practice – CLE's are such a pain in the ass and damn expensive if you're a solo.

What's funny is that of all the things I do to keep up on my legal education, CLE's are the most worthless. You learn much more by just keeping up on reading NVSC opinions. I also go and read up on older opinions in the area I already practice in.

yup. . that's why I say – in theory continuing education is good but I too get that education like you said – also by just lunches and banter with my attorney friends – and blogs.

I have an ABA membership, and I do their monthly free webinars. Without even breaking a sweat, I filled up last year. I'm sure there are other similar opportunities out there.

@ 3:16 here- What the what? ABA has free CLE with their membership?? I am very glad I posted a CLE venting post because once again the blog has given me some intel. I had no idea. (no sarcasm by the way). I'm going to check in to that. As an aside – wow. So ABA does this but Nevada bar doesn't and neither does Clark county bar. Last time I checked clark county bar membership was close to $200. If either Nevada state or Clark county bar comes with free CLE, I'm totally unaware. I know if you take a pro bono case or pay more fees for some lunches you get "free CLE". So – thanks for this info!

The ABA is run by people who are at war with small practitioners like myself. I wouldn't join if they paid me. The ABA has been captured by law school administrators cashing in on federal student loans, flooding the market with far more graduates than there are jobs.

If the market is flooded why is it so hard to find a quality attorney that works past 5? I have yet to talk with a law firm in town who claims the city is just flooded with talent.

I am guessing 3:22 Am is not an attorney, who is wondering why attorneys don't pick up the phone after 5pm. The reason is likely that this is the only time attorneys can get any real work done.

4:10 is absolutely right.

Blame the ABA for most if not all of the pointy-headed nanny-state burdens imposed by mandatory state bars on solos and small practitioners. Mandatory substance abuse CLE? Blame the ABA for starting that campaign. Lawyer speech codes via amendments to ER 8.4? Again, blame the ABA. A continuing glut of lawyers? Blame the ABA once again for rampantly accrediting some 204 law schools even during the depths of the recession and even as LSAT applications continue their decline and enrollments contract. https://www.americanbar.org/groups/legal_education/resources/aba_approved_law_schools.html

As more and more lawyers realize the ABA is not their friend, they are shying away in droves. I, too, wouldn't join the ABA if membership was free or if they paid me.

AS for MCLE, it's nothing more than a money-making scheme for state bars. The latest instance of bar association greed is the newly imposed $500 pay-to-play fee the NV CLE Board is extracting from third party CLE providers. And if you happen to take a class from an unaccredited provider, i.e., vendors that refused to pay the yearly tariff, you'll have to pony up another $5 per credit hour to the NV CLE Board to get credit. That's on top of your mandatory annual $40 fee.

The real joke about mandatory CLE, however, is that there's never been any empirical proof that MCLE makes lawyers more competent, more ethical or more professional. It's all about generating revenue and blowing smoke at the public. Here's one commentary that says it all.

The substance abuse CLE is the most wasteful hour of mandatory credit that could be humanly contemplated. I am very opposed to substance abuse, but I am also opposed to time wasters that do nothing to eliminate substance abuse. The ABA is one of the most useless organizations in existence and is probably counter-productive to the development of good lawyering.

Honestly I could not disagree with you more 10:59. Substance abuse is rampant in our community. The Substance Abuse CLE is paired with a mental health component which is also crucial. I don't need another hour listening to people drone on about standards for breaches of contract. But an hour to stop and realize that we treat ourselves, our bodies and our colleagues badly and that this profession takes a toll? Yeah that is actually pretty important.

8:45 you are exactly right regarding the CCBA and SBN. I used to remember when I was proud to be part of those organizations because you knew what they did. What do they do for you now? I was thinking about this as I was paying my dues– what value am I getting from the SBN for my money? I have no idea.

Maybe someone should ask the people running for Supreme Court how they would have voted on the rule change that made it mandatory to have one hour per year substance abuse CLE.
