Here’s a quick post for those of you working today:

I am loathe to accept a reporter's reporting of legal cases, but hot damn if the arguments did not remind me of the election lawsuits before and after the election. My guess hanging any argument on process is weak in the current environment. A shame, because process was meant to slow things down.
Economically, I wonder what hammering mines does? They can't take a mine with them, but will they cut costs (and maybe environmental protection corners) to stay profitable? Marginal mines will immediately close, that's for sure.
We all know some large tax increases have to be coming. Pop the popcorn to see how gaming, mining, and other industries fight during this session.
Todd Bice v. Craig Newby. Well that is not exactly a fair legal fight.
The ripeness argument, I understand. But how is any of the mining tax case justiciable?

I was her JEA her last year a half at NLV. I learned a lot and she kept things interesting. Too young…

Interesting that a lot of lawyers think that it pays to be a real p***k to opposing counsel, and that by always taking such a hard line, obstructionist approach that they will be far more successful in terms of results as well as financial earnings. And then when such attorneys pass, the best anyone can say is that the person had legitimate legal ability, and that they feel badly for the attorney's family. They then add that as far as that lawyer as a human being, or working against him/her as opposing counsel, the less said the better.
Now, for lawyers who are currently following that hard-ass, obstructionist model who believe being a jerk to opposing counsel is a key to success, I suggest the following.
When a lawyer dies who was truly one of the most successful in their given field of practice, it is almost always noted that in addition to being a great lawyer, that they were a great human being who treated opposing counsel fairly. One can be an assertive advocate without losing honor and mistreating opposing counsel. Being an attorney is a tough way to make a living. Let's not make it tougher. Some say the stress and demands of the profession ages one 15 years–and this seems anecdotally supportable hen we see that many more prominent lawyers die in their 50's, 60's and early 70's, than die in their 80's.
Everyone is singing Bill Terry's praises, and rightfully so. He was among the very best at Criminal Defense, as well as defending attorneys and judges in discipline matters, yet he always seemed to treat everyone well.
A few years back, another top notch Criminal Defense lawyer, John Momot, died and was also remembered as being truly decent–not necessarily always as warm and gregarious as Bill Terry, but still a really decent sort, and still a brilliant attorney.
I always thought that one of the best, and most successful, Plaintiff's P.I. trial attorneys(as well as mediator/arbitrator) was Pat Murphy, who died prematurely about 10 years ago. Very successful. Yet he was always so decent and friendly. Ever hear any insurance defense attorney say anything negative about how Pat treated them? I doubt it.

Gary Logan was a great lawyer with a skill set (and wardrobe) to die for. RIP.
RIP all of our colleagues who have moved on.
Three lawyers I knew personally, in one week. Shocked. Bill Terry was just a wonderful person. Gary Logan always helped me when I asked him about aviation law. Catherine has an 11 year old daughter. So sad.
Was Gary Logan related to Don Campbell? They were similar in many ways.
