First, here is your friendly notice about Administrative Order 21-01 regarding current coronavirus measures in the Eighth Judicial District Court.

Secondly, we are midway through the first month of January 2021. Typically at this time of year we like to discuss the state of the legal market in Nevada. What do you think about how things are going? Has COVID completely decimated any sectors of the legal community? Has it been a boon for others? Is there enough work to go around or not enough work? Is the market crowded with lawyers? Is any practice area dying? What practice areas do you think are going to take off? Will working from home be a new acceptable normal once the pandemic is over? Any trends you think are going to dominate the market in the coming year?

Covid? That virus was seized upon as a tool to get Trump out of office. Both the governor of New York and the mayor of Chicago announced the other day that it is time to reopen. Looks like we are good to go. Science.

True, but the public should never be used as pawns. In the beej incident, the only casualties were a couple of cigars. The power-grab efforts of today have gone too far. Voting these goofballs out of office, on both sides of the aisle, would be a good start.

To answer the question that was asked, I work in commercial litigation mostly. Haven't seen much of a deference. I do some estate planning as well, that took off. Seems a lot of people were thinking of their own mortality.

Public sector criminal law seems to be about the same for caseload. There are a few public defender positions open, especially with the spots formerly occupied by defenders who are now judges. The inability to do jury trials is creating a backlog, especially for those who don't/won't negotiate without a looming trial date (or who have opposing counsel in that position). There was a pay cut, but no layoffs. I'm hoping that the 4 day workweek, and ability to telecommute some of the time, sticks after the pandemic.

I barely knew the guy but he always acted like we were old friends every time I ran into him at the courthouse. Great lawyer and part of a vanishing breed. RIP.

I'm in litigation at a big, generally defense, business firm. I'm swamped. I was initially a little slow from March to June, but that blew up once everyone realized there was no waiting this out. I've taken more zoom depos in the past 6 months than I had in the prior 2 years. One problem is how do you hire and train up someone new? I think that's a main reason why I'm swamped. It's a huge ordeal to successfully bring someone on now.

My firm hired a new attorney who was sworn in around the time of the stay at home order. He initially assisted with simple assignment work that could be completed remotely. Then he started shadowing a senior associate and attending depositions once in-person depositions were allowed. Gradually he was given smaller cases to handle. He's fully trained up now.

1:35 – do you think that's better than just hiring a lateral that already learned the ABCs of law firm life in a more traditional training environment? We've interviewed tons of laterals, and I think that's how we'll proceed until the quarantine is over.

In the past clients didn’t mind and expected a young associate “in training” and being billed for both. Those days are gone. The tension is between the firm’s need for associate billable hours and the need to train the associate so they know what they are doing sooner as weighed against the client’s desire not to be double billed. Laterals already know what they are doing and only a percentage come without bad habits that you don’t see in the interview. So, ideally you train them with a senior attorney the first year the send the associate to seminars on substantive areas and on general trial techniques. That is how they become profitable at the fastest rate. Just my 2 cents.

I don't do real estate law. What's a good resource on a residential real estate agent's duty to disclose? In particular, duty to disclose to a clueless buyer a known condition on the neighboring property that might affect the enjoyment of the property. Thank you.

The Real Estate Division has a handy pamphlet written for agents that discusses a real estate agent's duties. I don't have the link, but you should be able to find it on RED's website for download. Note: There is nothing special about duties, it is basic bar exam law of agency.

One small caveat to be aware of in your question. Look at Davis v. Beling that discusses how much of the common law duties of agency and negligence have been superseded for real estate licensees by statutory duties. Make sure you read that case and compare it with the statutory duties.

Speaking of deaths, I had not heard that Catherine Ramsay died, the former NLV Muni Court Judge. She apparently died this morning from a stroke. She left a family and 11 year old daughter.
