Doesn't REP only apply against state action? My understanding is that employees or people in a neighboring car reported this to the police on their own accord. The REP is a fourth amendment evidentiary issue that probably doesn't apply here. The real issue is probably whether the acts were "public" under the criminal statute they were charged with. Hard argument to make. Not frivolous, but hard. I've been on the High Roller. You can easily see into the cabins from other cabins, and anyone getting on the ride would realize that.

Hafter may or may not appeal and if he does, he will likely lose. Then he will likely run against Bare in the next judicial election cycle. In my opinion, he's pretty predictable.
