Our firm, including our staff, are working remotely. We purchased laptops for our staff. I see several firms with attorneys working remotely while they make their staff go to the office. Shame on you if you are doing that. That reminds me of the rich folks who took the lifeboats, leaving spots empty, and screwing the working class people on the Titanic. Protect your people.

My firm went full remote. It was stressful to get it done, but it is worth it. Everything is cloud based, so for those that didn't have laptops, we loaded their computers up and sent them home with them. Everybody has the ability to print/scan/send mail, etc. I agree with 10:03 a.m. We need to keep our staff, our attorneys, and the general public safe. Just because we CAN keep our physical offices open doesn't mean we HAVE to. Stay home for Nevada!

I brought this up with someone at my office and was dismissed because they said it was impossible to make money doing BK. There's gonna be a tsunami of work. This seems like a good idea to learn BK. Thoughts?

I am researching the BK software out there. So many providers! And there will be a lot of Chapter 7s in a couple of months.

I remember BK being very profitable for me during the Great Recession – at first. Made several very good and lucrative placements with commercial law firms here in town. But after the first few years the big bucks were gone. Basic tenant of BK is that at the commercial level there still need to be some assets left to make a case profitable. Consumer BK will always be an option, but that's usually more of a flat fee, high volume business model.

I am out-of-state right now trying to protect my family on farm land back in MO. My relative is fighting with another separated relative over keeping the child safe (one is cautious and wise and my eventual opposing party is stupid and thinks the child can travel, etc. i.e., "There's nothing to worry about.") I do business law and know nothing of Family Court. How do I even file a Motion down there? Are they all video hearings now? No one answered when I called the Clerk's Office. I need to protect this child now. Thank you for any help and stay safe back in Vegas.

You can e-file as an attorney or visit http://www.familylawselfhelpcenter.org for instruction on remote e-filing. Most domestic departments are doing telephonic hearings if needed or if there is an emergency. Most departments prefer orders/decrees be emailed rather than having hard-copies submitted. You can still file an ex parte motion for Order Shortening Time (please email the order to your assigned department). Once you have your department assignment, you may wish to call or email the law clerk or JEA. Many working in family court are working remotely. Some folks, like me, are actually at their desk. I hope this helps.

Is the child located in MO or in NV? There is something called "home state" which controls which state has jurisdiction over the child. That is the very first thing to determine.

If NV is the child's "home state," our Self-Help Center (which 1:55 gave you the link to) is a great resource.

Our firm is completely open and not allowing anyone to work from home. Most of the staff are young so the virus will not impact them. Shutting the firm down would just allow staff to be lazy at home.

Sounds like you're a shitty leader on multiple levels. If your staff won't work unless someone is watching, you've done a poor job of training them and structuring your firm. Also exposing your staff (and their families, which may include at-risk individuals) during a pandemic is a shitty thing to do.

I suspect that it will be a formal Executive Order and that the Executive Order will have penalties. My guess is that Sisolak wanted to rush out a press conference before his team was really ready to issue the EO because there is so much nuance in there.

Not true. There is a public safety exception. You learned about it in Torts 1, in the form of government destruction of houses in an 18 something city wide fire. (That is unless you were skating through law school on Nutshell notes). The case deals with compensation for property loss, but the public safety power is discussed.

Except the Governor has not indicated criminal penalties against individuals to shelter in place or even any executive order against individuals. The Executive Order only has penalties against business entities that remain open. Businesses cannot be subject to house arrest.

He actually did not list any essential businesses in this EO. Instead he used the opposite approach of "If I did not list you, then you can stay open so long as you social distance." The interesting thing is that he appears to order that no essential business can have more than 10 people. Hospitals? Medical offices? I know he is doing this on the fly but his directives/orders often times leave as many ambiguities as they solve.

Take-out, curbside pickup, or delivery aren't feasible for grocery stores. So they are left with limiting access. But they also can't allow lines to form with people closer than 6 feet. So expect to walk at least a mile in line, shuffling 5 feet at a time, 6 feet behind the person in front of you, before you can even enter fucking Winco.

I might understand that if it were tickets to a hot concert. But to buy bread?

Riots will absolutely break out.

4:12, you need to read Section 4 more closely. The last bullet point states that any Essential Licensed Businesses that cannot provide takeout, curbside, etc. are just required to implement sanitation and disinfection policies that comply with the CDC. When you say things like "Riots will absolutely break out," you are only propagating unnecessary panic. Are you even a lawyer?

4:45, maybe you need to re-read Section 4. Nothing in the last bullet point indicates that the sanitation requirement supersedes the limited access requirement. If you can't provide curbside, delivery, or takeout, you need to both sanitize regularly and restrict access.

Question: Justice Court of Las Vegas Township said that it was halting Writs of Execution. EJDC did not state that in its Administrative Order. Can you still get writs from EJDC? Will the Sheriff/Constable serve them so long as not from LVJC?

Judge Bell issued 2 new Administrative Orders late on March 20th (20-09 and 20-10). All Writs are stayed. Everyone really needs copies of these 2 Orders because it effectively turns the practice of law in this District off. All Orders to be submitted electronically. No courtesy copies. No subpoenas. No IMEs. If I knew how to post them I would; they are not yet up on the Court's website. http://www.clarkcountycourts.us/general/court-rules-and-administrative-orders/

Here is my problem with blacklisting: unless you are in those firms, you have no idea if they are "making attorneys and/or staff go into the office to work." 8:53 shows the problem by alleging that a firm is still open. Sure– firms are allowed to stay open.

There is a HUGE difference between firms staying open, firms allowing attorneys or staff to come into the office and maintain social distancing and those firms requiring people to come into the office. Different firms are dealing with it differently. I know of a firm that the attorneys agreed that they would be in the office and the staff would be at home because attorneys have separate offices set apart while staff is in cubicles. I know of a firm where they are rotating who is in the office on what days to keep population down and spread apart. I know of a firm where everyone is working from home except one staff person and one attorney just to troubleshoot if anything happens in the office. These are turbulent times. People may not like the way our firm is handling things as people too open or too closed. I hope to be able to tell you in 18 months who was right.

Sisolak's Declaration allows law firms (and any other non-listed industry/business) to stay open if they trim down the number of people in the office and follow social-distancing practices. Take a look at Section 8. If the Governor allows it, what's the objection? Plus, based on this Declaration, half the people in the state are still working.

non-essential? Tell that to the people sitting in jail who were arrested over the weekend that they are not entitled to counsel. Tell that to the woman who needs an emergency pick-up order or TPO from family court. We are absolutely essential and just need to take precautions in the office. Non-essential? Tell that to the pregnant mom and her baby's health is at risk , because you are more concerned about making money . Tell that to my 60 year old boyfriend who is battling cancer who your client are spreading the virus to. Tell that to my RN sister who works at UMC who iscworkung without PPEs, look it up. Tell that to to the elderly and those who have underlying conditions. Tell that to your support staff who are risking their lives so you can make a buck. You are nonessential spreader.

8:58 did come off pompously sanctimonious. And yet his point is valid– lawyers are essential. Professional services have been defined as essential under the Executive Order and allowed to stay open. That does not mean offices packed with people. It means able to transact business.

I am not certain where the ability of an attorney to continue to represent clients (telephonically and via email) puts a "pregnant mom and her baby's health is at risk" or jeopardizes "my 60 year old boyfriend who is battling cancer". 8:58 never said that he/she had support staff, that he/she was making support staff come in or that he/she were even going into an office.

Frankly people are talking about just keeping society moving forward–processing criminal defendants on both the prosecutorial and defense sides, advising clients of their personal and business rights in a time of panic. You are confusing the practice of law as an essential business with making "support staff and other attorneys come in." They are quite distinct.

Lawyers are "essential businesses" because that is what the law says. Has nothing to do with what any of us think. If you disagree, change the law/Executive Order. But so long as there are laws to be followed/ignored, lawyers will be an essential business activity.

–> 12:12- The CDC has not ordered law firms closed, only social distancing and hygiene. Executive Order 003 from the Governor says law firms are essential businesses.

–> 12:15- Pursuant to subsection(w) of the Executive Order says that you are wrong (again). Ironic that you would come back with "you do not know how to read" but since you posted 4 times in 7 minutes one should really not be surprised.

–> 12:19 And then one realizes that they are probably being trolled. No Wolfson is not letting all criminals go. The Court issued specific guidelines on citations and appearances that did not come from the District Attorney; numerous offenses continue to be prosecuted. Police stations are not closed.

That is correct about police stations. They are closed. CDC is advising social distancing and only going out in emergencies. Maybe you can explain how your law firm is special and is an essential business, because it is not.

Sure. The Governor's Executive Order 002 and then again 003 stated that law firms are essential businesses. It is really that simple. Don't like it? Change the law. Convince the Governor otherwise.
