Question about referral fees. If I refer a case to a PI attorney in writing via text or email as an example, am I entitled to a referral fee, or do I need to enter into some sort of more formal written agreement?

The common practice is that a text or email is sufficient for the initial referral and then the PI firm drafts a fee sharing agreement for the client to sign.

Make sure it is all in writing no matter what the form is. A lot of the people in that practice tend to be less than forthcoming when it comes to referral fees IMHO.

I don’t do PI, but when I pay a referral fee, I just put it in the retainer agreement with the client. “Client agrees and understands Saul Goodman will be paid X% of fees collected, which will not alter or increase fee charged to the client in any way.” The client has to initial that paragraph, and I bold the paragraph. I’ve never had any problems with the client or referring attorney. Just do it up front and make it clean. Then make sure to pay it and be honest!

When I got personal injury cases, I would have a joint rep agreement and protect myself that way. I learned the hard way. Got screwed on a 25 per cent referral fee on a 7 figure personal injury case. I got the client to the handling attorney. i got assurances I was on the file and would be paid a referral fee. The case settled without my knowledge and the funds were disbursed. They said they did not see any notes in the file. At that point it was too late. The client was long gone-got a couple hundred grand and took off. I got screwed out of $100K. Ouch.

Jane Doe has aligned herself with a rich cast of characters, I mean lawyers. Where are Jane Doe’s police reports? 9-1-1 calls? Police investigation? TPO? Medical records? When a 56 year old man hooks up with a 20 year old woman, it’s not because of his sparkling personality. It’s all about the size of the wallet. This is a pay to play case. I have no sympathy for a woman who uses her feminine ways to separate a man from his money. The same as I have no sympathy for a man who feels used for spending money on a woman. Sounds like a mutual transaction.

We can’t assume that she is telling the whole truth. Just like we can’t assume that Sharpe is telling the whole truth.

Smells kind of like a shakedown to me. The complaint just reads way too “wo is me” and while complaints are always this way. This one is a bridge too far.

I am not accusing her of making it up. I am however, skeptical. Also, according to Sharpe’s attorney’s public statement, she asked to be dog collared and choked.

Someone made a comment yesterday about the decline in the quality of legal assistants. I want to comment on the precipitous decline in the quality of process servers. Have shopped my business around and am getting the most tepid efforts. Very much “I knocked, they said they do not live here, pay me for non-service.”

You mean, I knocked. The wife (a forty year old woman who confirmed she lived there) says her husband would be back later, his car was in the drive way and I could hear them, but I agreed to come back later and told her I was trying to serve a lawsuit. Pay me for non-service and pay me to go back. Next four attempts no one opens the door. errrrrrrrr. Why again didn’t you serve the wife?

I knocked. They answered the door. Person matching description of wife answered the door and said that he does not live here. I have to take her word for it even though Plaintiff has a copy of his drivers license saying that he lives there. Next 6 attempts, no one answers the door even though the blinds move every time that we knock.

I started using First Legal for this a couple of years ago. They have been pretty decent so far. They havent spent the night hiding in anyone’s bushes or anything like that, but always a solid effort and no big screw-ups or sticker shock on the bills at this point.

It’s called the draining of the swamp. But to be fair, sloshing is not entirely inaccurate.
