A few years back, commenters were discussing the fact that some judges are off the bench quite a bit more than you might expect. Now, it’s become a yearly tradition for us to discuss this topic each December.  So, are the judges generally spending enough time in the courtroom this year? Or should we say in BlueJeans? Which judges should be spending a little more time on the bench? Is there a minimum standard? Which judges would you commend for making the best use of your time? Which judges are always late and don’t respect your time? How has the pandemic affected the productivity of the judges you encounter? Are they showing up to BlueJeans on time? Are they ruling on the briefing instead of dealing with the hassle of a hearing?

I am pretty tired of blue jeans. The constant feedback/weird sounds, getting dropped from breakout rooms, etc.

I have had mediocre Blue Jeans appearances and really good appearances. A lot depends on how well the court's assigned personnel are running the show. Bad connections are bad connections, and the fault usually lies with counsel. The court and counsel are working out the bugs. If you have problems seek help, if you see a problem and have a suggestion for the court on how to run the system. Provide it. We are all in this together.

When we return to "normal", the most helpful thing for the bar and public is to fix the elevators at the RJC. If judges and court personnel are not aware, there is a line in the morning from the elevators almost all the way back to the security checkpoint.

I personally would like to take a month off – starting now – and Judges likely could use the time too. This year has been an utter disaster for stress/mental health. I know some have been able to travel but most of us have been stuck at home w/no vacation or escape from work, the news, life. I've reached a higher burn out at this point than ever before so there is no way I'm going to be critical of any person – including a Judge – for taking time off. Caveat to that – the Fed Gov. Keep working jackasses. You've had plenty of time off, travel and full pay – get the relief out to the public (which most of us lawyers won't get) but get it out the freaking door before our economy is irreversibly damaged. I talked to a JEA today who said that is exactly what is happening at the RJC. Between the Governor's Phase 2 shutdown and anticipated extension of the shutdown and the transitions which so many departments are going to be experiencing with the new wave of judges (and present judges taking their vacation before they lose it), they are really shutdown for all intents and purposes for December.

I was at a Judge Crockett motion morning recently. While I wasn't thrilled by the fact that he refuses to stagger hearings — requiring dozens of attorneys and parties to be present at 9 when he knows for sure that he won't get to some until 11 — I was impressed that he is not taking his foot off the gas in his last month. In fact, he seemed to have every intention of clearing out as much of his docket as possible before he leaves. I wonder if every exiting judge takes their responsibilities so seriously.

Crockett is one of my favorite judges but it's really hard to explain to clients why I billed three hours for a status check. Having his entire morning calendar show up at the same time doesn't make sense to me.

Not calling out any judge in particular. Many work pretty hard and are conscientious. Some with heavy morning criminal calendars seem to leave by early afternoon. Some are lazy, and show up and do just enough to avoid the Commission on Judicial Discipline.

Justice Court has some of the worst offenders. Several district court judges were gone most of the time, even before Covid. The Supreme Court, under its supervisory authority, should mandate that judges account for their time and provide for a reasonable amount, but not extraordinary amount, of vacation time. Public records should reflect how long a judge's calendar goes dark, how often it is covered by a senior judge, how often the judge agrees to help with overflow, etc.

I think a large number of judges are lazy and derelict in duty, but having some kind of mandatory minimum hours or cases or face time is deeply offensive. How about attorneys stop over-lawyering instead? Complaint, answer, discovery (without disputes), summary judgment motions, and then trial. That's it. Save the fancy shit for LA or NYC.

Justice Court is bad. Muni Court is appalling. There's not a judge on the bench in Muni working more than 20 hours a week. There's zero accountability. Lazy and derelict is immensely understating.

Has anyone traveled out of the country since the lockdown ended? Feel safe? Did airlines/airports follow safety measures such as social distancing etc.? It's hard to ignore the amazing prices for a Christmas vacation.

No. It is unsafe. You need to stay in your home – no indoor dining, no gyms, no travel, no gathering with friends, no walking outside without a mask, even if you are alone or in the car. You have to give it 100 days!

How dare you even think about traveling anywhere – do you want to kill grandma?

The Pfizer vaccine? Of course. Moderna? Probably if offered. But hte good point is that I am like Tier 56 so the vaccine is not going to offered until June to people in my risk profile so a lot more will be known by then.

It is amazing to me how many landlords appear either through a corporate representative or a property manager. I've only done a few pro bono cases, but each time I saw several. Do the hearing masters not know they cannot do this?

Procedural question: Client has a default judgment against him, wants to try to set it aside. Do we need to file some kind of Appearance first, or is the first appearance the Motion to Set Aside Default?

You can file the motion to set aside first without an appearance. I'd see if counsel will stip.

The first filing of a pleading or response in a case acts as your appearance so filing the Motion will accomplish that. If you want to add yourself as attorney of record before you file the motion, of course you can file a notice of appearance.

Quick gossip story from this morning: Today was summary eviction appeals in front of Chuck Thompson. Vegas Valley Evictions has its (non-attorney) rep on BlueJeans enter her appearance. Thompson shoots her down and said "Not an attorney. Not appearing." She insists that she is LL's representative. He reiterates again "Not an attorney. Not appearing and not representing parties." She tried no less than 4 different cases and got snippy that the judge was not going to stop her from representing her clients. Ballsy.

I have seen a judge in Henderson tell someone in a similar situation if they said another word he would find them in contempt and report them for prosecution for UPL

dear 2:26pm. you are completely and utterly wrong. I am not only a front line worker but I am essential, indispensable, and wholly requisite in my position. Without me, the whole judicial system would falter and the world would come crashing down. The NOE is just to set the clock running for other parties to take action, so unless there is a chance of that happening, it's probably not critical.
