This is not just a prosecution for inciting breach of peace; if that's all there was to the posting then, yes, I would agree such a prosecution was unsupportable. But this involves serious threats of violence and in view of very similar social media posts prior to recent events in Michigan I feel that the postings have crossed a line. The AG should pursue this case.
Telling people to form a militia is far different from telling folks to meet at the governor's mansion at midnight and burn it down. I don't see the specificity needed to get a good case on in this instance, feels politically motivated. I also don't see Sisolak as a victim here. If he puts on his big boy pants and leads us out of this mess, he'll gain my respect. But so far, the word tyranny, while extreme, seems to linger out there as a meaningful descriptor of too many political leaders' behavior right now, all centered around the power grab of Covid-19. We need some proper push-back from the legal community.
I predict this case will ultimately be settled for a misdemeanor with a stay out of trouble clause. It's not worth a felony. If some prosecutor tries to take this to trial, there will be a not guilty verdict or a hung jury.

Concerning the extensive discussion on yesterday's thread concerning "civility", and how it continues to be developed at legal seminars, and written about in legal publications, I agree with the posters who insist nothing will change until the judges start hammering the miscreants who are the worst offenders.
These articles and presentations are almost always geared toward attorneys, and how the attorneys should address serious civility violations. But the topic is more appropriately addressed to judges, and should be presented more at judicial seminars.
Now it being understood that continuing to present this issue to attorneys is not particularly effective, I will concede the presentations on this issue can often be interesting, and even somewhat entertaining. The speaker, as well as the audience, often have some very interesting civility horror stories.
But entertaining an audience, and maintaining their interest level, at a legal seminar is not nearly as important as informing the audience, and providing them effective tools. But attorneys can't solve the civility issue of these chronic offenders. Again, judges need to lower the boom in the more egregious cases.
You are so close to hitting the nail on the head by identifying judges as part of the solution–but you must also recognize that judges are just as much the problem. They expect to be treated one way but don't treat the lawyers the same.
I don't generally see judges behaving discourteously, even when attorneys are sanctionably obnoxious. I was in front of Conrad Hafen once or twice, and he went out of his way to be a cartoon character of an evil judge. But other than him, about the worst demeanor I see from judges is just well-earned exasperation. And I practice in front of criminal, civil, and family courts.
You are lucky. I have personally had my constitutional rights violated by a judge for doing my job. I also had a judge call me unethical for doing my job. These judges are out of control. The Nevada Supreme Court goes after attorneys for game e.g. Danny Tarkanian. Report them.

11:41–I've never seen a judge effectively handle these situations, even when dealing with people who most attorneys know are awful repeat offenders.
So, I've resorted to self-help, which is only marginally effective. I practiced a lot of Family Law for years, and got to the point I would not accept a case where one of these vile people were on the other side, and I was willing to forgo the fee I otherwise would have received.
But, at best, that only solved half the problem. After all, if I was the one filing a new complaint, or re-opening a closed case via a motion, I still ran the risk that the opposing side would hire one of these Frankensteinian creatures to represent them.
But, at least I reduced the issue by roughly 50%.

11:49, you identified an additional problem. Judges not only fail to reign in these people, but some judges also expect to be treated with a lot more deference than they treat attorneys.
I see judges not allow attorneys to argue, or unfairly cut them off, ridicule the attorney's position.
That said, we've all had opposing sides, that due to the weakness of their position and other factors, attempt to hijack the dialogue by veering into some red herring matters. Judges can, and should, interject and re-frame matters when that occurs. I appreciate that many will disagree with this and perhaps I am wrong. But I never felt that on motion calendar that an attorney should have an unqualified right to argue for a significant period and to argue however he or she wants, even if the presentation is not relevant, or far worse, misstates the law and facts.
Also, if one ever argues before the NSC, they quickly learn that they won't be left alone to present however they want, and they seldom get to use their allotted time however they want without interruption. If they are wrong on the law, or are veering from the important issue, these justices will interject. Unfortunately they even sometimes do so when the lawyer is right on the law and facts, and is staying on issue. But that is another matter altogether.
Unethical judges go after certain attorneys who have done nothing wrong to deflect their invald, bad decisions. I have had it done to me twice. I am reporting it. I am sick of this unethical behavior.
I was once very personally, repeatedly and aggressively insulted by a judge during a hearing. The judge did the same thing to opposing counsel was well. It was unhinged and over-the-top. Afterward, opposing counsel approached me about filing a complaint with the judicial ethics commission. I declined, confident that such a complaint, though it may have merit, would go nowhere and only serve to further alienate me with that judge and others.
12:55-understood, but some attorneys are at a certain point in their career where they still can and should care.
As 12:51 indicates, one must always reflect on the liklihood of success(in reporting a judge) plus any career implications.
Some attorneys are in some niche specialty wherein they are only really appearing before the same couple judges. In such instances, they should reflect before really burning their bridges.
Thus someone like 12:46 is well-served, before reporting a judge, to sit down with a colleague who he/she really trusts, and get their viewpoint on the issue.
It's a lot more-complex than the convenient non-nuanced issue of whether we are in the right, and the judge is in the wrong.
I am not, of course, excusing any dreadful judicial behavior, and I have been on the receiving end of my fair share. But I am suggesting, as have others, that, before we report a judge, we reflect on the likelihood of success of the complaint, nd the career implications.
After all, no matter how right we are, and no matter how wrong the judge might be, in the large majority of such matters the judge is not disciplined, and the only one who suffers professionally as a result of all these efforts may be the reporting attorney.

That said, not to sound self-righteous and climb up on my soap box, but some behavior is outrageous to the point we can and should report it,even if we believe it may be unsuccessful to do so and even if we believe some judge may hold a grudge about the situation.

The commission on judicial discipline moves too slow to actually accomplish anything on a current case. The only good outcome for the reporting party will be that the judge gets a slap later on down the road. Might be career implications for the judge, but in the interim, they'll screw your client. Motions to recuse are so rarely granted they're almost a joke to file.
