You’re driving through a neighborhood next to a golf course and suddenly a golf ball smashes into your windshield. A golfer runs over, apologizes, and gives you his number. When you call it, he refuses to pay and denies liability. Who is liable for the damages? [Apparently, KTNV couldn’t find anyone willing to opine on the record.]
I live in Rhodes Ranch and drive past the edge of the golf course every morning and evening; fortunately I haven't had that happen yet. If it did, I would be giving the info that I had from the guy (presuming I could find the person) to my insurance company, file a claim with my insurance company, and let them deal with it. This 'what if it was a dog', 'what if it was a child' BS is just to inflame the situation. If it was, then I suspect the course wouldn't be treating it is a nuisance because it would have been an actual injury not simply a minimal financial injury of a windshield or window going out.
Seriously – if you live in an armed guard gated community where you drive past a golf course to/from work, where the HOA dues are $155.00/month and flinch at replacing a windshield, you need to move.

The driver needs to hire me to sue the golfer. This isn't about money, it's about PRINCIPLE! I will only cost you $5k in attorney's fees and I'm sure we will recover the $200 to replace your windshield. But like I said, this isn't about money.
You clearly do not understand how "personal injury" cases work. The victim needs to get back rubs at a crooked chiropractor for 3 – 5 months, rack up $8k-10k in bills, then go after this bastard golfer for the mental suffering he endured. Oh, and the golf course owner for failing to maintain safe fencing. Should be good for at least $20k plus fees and costs. Of which you get 40%.
