  • Law

  • The Special Legislative Session for funding a possible Raiders stadium starts today. It will have to recess for Yom Kippur tomorrow evening if it isn’t finished by then. What’s the over/under on how long the session lasts. [Las Vegas Sun; RJ]
  • There were lots of developments in the presidential election over the weekend with the release of a tape with Donald Trump making lewd comments and the second presidential debate taking place. Trump crushed Clinton in the debate last night. His "you'd be in jail" zinger was priceless. Still laughing about it. Clinton is a proven fraud and has made tens of millions of dollars selling influence for a living. The best she can do is plant some locker room banter with her friends in the media? True, the entire establishment media is working overtime to smear him. I can see the average voter buying a lot of the bull. Still, he did great in the debate last night. For Clinton, of all people, to smear Trump as a sexist while a row of her husband's actual victims watch is priceless.

You can't make this up. She is a crook. A thief. A liar. A traitor. Just look at her Goldman Sachs speech. She tells Wall Street to not worry, she says populist stuff to get elected, but she is on their side. Scum of the earth.

And let's not forget she will immediately grant citizenship to 30+ million illegals, thus making the US like California, where no Republican can get elected statewide. This election is a game changer. Voting for her is to vote for the Californication of America. A long slide in thirdworldism. That is why Trump has ~40% support among hispanics. The ones who came her to escape Mexico and work do not like the Obama bums flooding across the border. "Hey, man, I left Mexico for a reason. Don't bring Mexico here!"

After that tape, Trump is toast. Last night he revved up his base and basically dared GOP leadership to abandon him, but he didn't convince a single undecided voter to vote for him. With 29 days left, his only hope is something bad happening to Clinton. Everyday that passes without that is a good day for Clinton.

I can't figure out why anybody is surprised by that tape or would decide to pull their support from him after it. This is a man who has said so many things that would tank the career of any other politician and has come through relatively unscathed. His saving grace is that he is facing an opponent who is disliked on a historical level. That said, I'm voting for Gary Johnson, who knows nothing about foreign policy because I can't stomach the idea of the other two goobers running this country for 4 years.

There isn't a number of current elected officials or appointees that you could name as having engaged in the same behaviors and statements as Trump, or as holding an equivalent number of completely irrational beliefs, which would surprise me. Well…anything under 30% would surprise the HELL out of me….but the point is that Trump is poorly managed enough to get caught on tape saying and doing the things that the rest of the government does behind clothes doors with a warchest full of taxpayer provided hush money.

Border is the subject of pending proceedings. Her offense does not qualify for summary suspension under the Supreme Court Rules. The allegations in Pengilly's case do.

It is not a question of "worse" or severity of conduct or consequences. SCR 102(4(b) provides temporary suspension upon affidavit "which shows that an attorney appears to be posing a substantial threat of serious harm to the public." Good chance that the OBC asserted that pulling guns on deponents (alleged) constitutes substantial threat of serious harm going forward.

He was on the Howard Stern show, the master of gross. Trump was on a shock jock show, talking sh**. While I agree that Trump many times fails in elocution, I think he does make up for it in smarts and abililty. That's all she has? a 10 year old radio stint? relying on TV of a speech about children she has been touting for 25 years – where is an original thought?
On the other hand, Ms. Hillary, has over the past 30 years, been in more scandals, than any 10 other people I could name, one of the more current being playing fast and loose with our national security, while holding one of the highest posts in the land. If she was so flippant, "I can't remember" (if the concussion gives her that much a problem she should not be president), and all the other excuses and side stepping in true DC doublespeak fashion, not to come clean about anything, I have a real problem with her being president. She is as transparent as a 10 foot brick wall in the dark. The media has been bought and paid for.
In the end, as it has been for the past few election cycles, it is not the best person who should "win", but rather the lesser of the evils, which is a statement of how corrupt and sad the atmosphere and MO is in DC. Obamacare is imploding, the security of our borders are questionable,and the sheep will be sheep and believe everything they see on TV. WE have allowed for the "dumbing down of America" with the education of our children, and now we will be complaining how they are not prepared.
It is a very sad state of affairs in this country, and we really do not need the same old, same old. Can't vote for Billary (and I am a woman). This country has had both good and bad presidents – only the history will show – so I say, go with the non-career-politician, he can't be any worse than what we have, and certainly better than the alternative. He may actually shake them all up in DC -frankly they need it. Trump may not be a perfect choice- but then none of them are.

Follow the Discipline cases at the Supreme Court level and it is frightening. The State Bar under David Clark encouraged people to self-report and gave a level of discipline commensurate. There are cases that David offered people public reprimands that Stan is going after multi-year suspensions. There are cases where David negotiated limited suspensions that Stan is reneging on written agreements and going after 5 year suspensions. I do some ethics/bar hearing work and can tell you the perception that the Bar is patsying cases right now is completely not true.

The Board of Governors put him in charge because it wished to have a public face that was tough and prosecutorial. Stan doesn't do any of the lawyering; he is the Bad Cop to send the underlings to say "I know we agreed to a 6 month suspension but Stan is requiring disbarment. Nothing I can do." Frankly it has gotten ugly in the last year since Stan pushed Brian Kunzi out of the way and came over there.

I will tell you one thing. Bar counsel is not a united front. I think there is some divisiveness going on, and I hope it gets looked into. You should not be disciplined for certain issues. One thing I can tell you, get everything in writing with them. That is all I am going to say.

Bar Counsel is not a united front and there is HUGE dissention (and hence turnover). But the discretion that Asst. Bar Counsel used to have is gone. It's Stan's decision, and that is final. The days of the Conditional Guilty Plea are gone. They want hearings on everything. The Trust Account stuff is ridiculous. The good faith disagreements with Clients are ridiculous. And they are completely abandoning all precedent on levels of sanctions. But upon good authority this was all at the behest of the NSC who passed word to the BOG who caused upheaval in the OBC. Things have gone crazy over there.

I worked with Brian Kunzi back in the 90s. Very ethical and fair-minded. Too bad he wasn't selected over Hunterton. I've never seen so many public reprimands as I've seen this past year! For stuff that was just a private reprimand before, now it's public and there are so many published that good luck on finding a decent attorney with that hanging in your record now!

Responded to an inquiry, IOLTA related more than a couple months ago. Minor, addressed it. Document everything is all I can say when interacting. Be honest, but be firm. You have a right to defend yourself. No reason for Bar Counsel to be confrontational.
