What do you think about the candidates so far? Which Supreme Court justice(s) do you expect to have to fight for their seat?
Not like I’m going to do anything about it, but elected judges are a problem. Being a good politician and being a good judge are not always the same thing. We’ve gotten several good judges, of course, but who in their right mind wants to run for their seat every few years, seeking donations and playing politics along the way? It’s a classic case of those who desire the power are not the ones who should have it. We should move to appoint and retain.
Not to pour gasoline on the judicial election discussion, but I agree that judicial elections are a major problem. IMO, judicial elections must stop if we want to bolster our reputation as a favored state for corporate formation (thanks Elon!). We have obviously had some great candidates and judges over the years, but I have heard many friends outside the legal profession say they vote for judges based on factors like (a) how “judicial” the last name sounds, (b) perceived political affiliation, and (c) billboard photo. The result of non-legal folks voting for judges based on factors like the foregoing has undoubtedly led to instances of the better candidate losing and other would be good candidates from not even wanting to bother running.
Like 8:55, it’s not like I am going to do anything about it, but here’s to hoping that someone someday does something to preserve the integrity of the judicial bench.
I had a hearing this morning and was connected 8:55am to about 9:50am this morning. There were a couple times where the judge’s audio muted or the judge froze for a few seconds but otherwise it worked as usual.
At this point, an AOL email account is such a relic that it’s almost cool again. It’s similar to the way hipsters wear vintage clothing. Of course, the difference is that when hipsters do that, it’s intentional irony.
An AOL Email address shows that you are old enough to hold judicial office.

Why do sitting judges get to not disclose a mailing address, email address, or phone number? I get not disclosing their residence address for safety concerns. Also, why do we care what a judge’s mailing address, email address, and phone number are such that they are made available to the public? Their physical address obviously has to be disclosed to the NVSOS to confirm that they are a resident within the geographical area required, and their opponents need it to confirm their address in case they need to challenge it. Does the public need it?
The video is private now. A man was going to be remanded into custody. Just before this, his lawyer was arguing about how he should get probation. Judge Holtus remarks that she cannot allow that to happen based on the man’s history. The man then runs towards the bench, jumps over her bench, tackles her and starts punching her. Then the law clerk and court marshall start punching the man.
Shut down parole and probation completely. Use the savings to build a bigger jail. No probation for anyone. You get 90 days, you do 90 days.
All this probation and programs shit does nothing. A criminal won’t stop being s criminal until he/she/they want to stop being a criminal.
The whole concept of probation is flawed. Think about it: Your asking someone to timely pay fines, attend classes, meet with their PO, and stay out of trouble. If the person on probation had the ability to do all those things and follow timelines and guidelines, the person would not be in that situation in the first place.
Keeping the parole and probation machine staffed and running is expensive and ongoing. After the initial expense of building bigger correctional facilities, keeping people locked up is a lot less expensive in the long run. Also, keeping the animals off the street and locked up is better for quality of life, business, and public safety.
Yeah those per capita and total number of people we have locked up already are way, way too low. No way some third-world country is going to lock up people than ‘Merica.
I don’t have a problem with locking up (and throwing away the effin key) the violent offenders like this puke. Reserve probation for non-violent and first time offenders. But I am OK with getting rid of parole like the feds did.
You’d really think that attorneys, or at least folks who frequent a legal blawg, could comprehend the difference between pre-trial detention and bail versus post-conviction prison.

This is horrifying. I watched the video. I am really upset this happened to her. It appears her law clerk is a bad ass and went to her aid to help subdue the attacked. Kudos to him. He stood up and jumped in. He’s a hero. Her marshal is a hero. God bless them all and praying for Judge Holthus in every way possible. She doesn’t deserve this is or to fear going into her job. This is shocking and I hope she knows she’s got a ton of support.
Did court security screw up by only seemingly having less than adequate security in the courtroom? I see the Marshall sitting down seemingly disinterested and (I think) another court security offer standing in the center alley (you can just BARELY see him there right before the shit hits the fan).
There were a few more security officers in the courtroom up until only 1-2 minutes before this happened because they had walked out a chain gang to be transported back to the jail.
Don’t do that 2:53. Security can only do so much without sitting directly between the judge and the defendant. The marshal was there within seconds. The only reason the law clerk was there first was because he was sitting right there.
And when the defendant superman’d over the bench you can see the marshal just miss grabbing his feet. But I guess we always have to try to ID someone else to blame.

At 7:09, the law clerk, hereinafter referred to as “BadAss Barrister, or BB” drops his jaw in surprise, and the DD has approached the bench. He did not ask to approach. How rude. We may be looking at a contempt. The marshal rapidly enters the frame from bottom left, no doubt to politely escort the defendant back to his seat.
By like 7:09.5, the marshal misses his blocking assignment, and DD leaps over the bench. MKH scrambles, trying to find room, but it looks like she’s going to take the sack.
At 7:10, the DD has completed his jump, but BB is in motion and lands on DD’s back. MKH tries to stand up but it brought back down.
7:11 – BB tries to pull DD off Her Honor for the next few seconds.
7:14 – Officer enters the frame from the right, and the marshal that missed stands up.
7:16 – Defense counsel checks on his client. Is not impressed by his client’s behavior behind the bench. Another officer of the court, The Bearded Badass in Blue enters the fray.
7:20 – DD is removed from Her Honor.
7:23 – Officer starts swinging.
7:28 – It looks like DD gets close enough to kick Her Honor, despite the efforts of BBB, Officer Swinging, and BB.
7:31 – BB throws some kidney punches while BBB tries the arm bar.
7:34 – BB busts out the Hammer Blows, Officer Swinging changes it up to overhand rights.
By 7:41, BB extricates himself and checks on Her Honor.
It seems that they responded as quickly as could be expected, even if there were a dozen more officers in the courtroom.
Not sure if there was a specific failure here, but it will certainly need to be revisited. In the past I have seen a marshal standing within arm’s length of the defendant when they know it is someone who is going straight from the courtroom to prison. A

Wrongheaded thinking. The number of offenders in custody/jail should not, and cannot, affect prosecution of new crimes.
