Can anyone on here comment on the constitutionality of Sisolak's ban on religious gatherings? Since this explicitly targets a suspect class (religion) wouldn't this have to pass strict scrutiny (compelling interest and narrowly tailored)? Perhaps it meets the compelling interest test given the pandemic but it is hard to see how it the most narrow possible way to accomplish the government's purpose. I wonder if this aspect of the order will be challenged.

He didn't ban religious gatherings altogether. He applied the same standard to religious gatherings as everything else: no more than 10 people.

What 8:43 said. And even if strict scrutiny applies, this is a compelling interest and I don't see a better less broad way to accomplish that interest. It would pass strict scrutiny.

Did the Nevada congressional delegation drop the ball by excluding legal gambling businesses with less than 500 employees to be excluded from PPP program?

13CFR110(g) excludes "Businesses deriving more than one-third of gross annual revenue from legal gambling activities."

I've heard this exclusion is being interpreted to exclude smaller vendors to Casinos, gaming bars, etc.

Dan Hamilton has never practiced law in Nevada. In fact, it looks like he's never practiced at all. Why should a guy who's never argued a motion, never drafted interrogatories, never taken a deposition or ever taken a matter to trial be involved in such an endeavor, much less helping to lead it?

Agreed. It needs to be a cross-section of practicing litigators. Prosecution and defense, Civil plaintiff, defense, and commercial. Family practitioners only for those slots. Who cares what some academic who has never practiced thinks?

Dan Hamilton may not have the wisdom and experience that can only come from practice, but he could provide value to this project the more I think about it. He has the ability to marshal free labor in the form of law students. He also can lend the credibility of his title (the general public probably assumes that he has distinguished experience practicing law). I wonder if Jon Ralston understands that Hamilton has no experience. Maybe he does and doesn't care. As long as Hamilton restrains himself, as described, his contribution could theoretically be helpful. I don't know him well enough to speculate about whether he would, or whether he would want to wade into the x's and o's of the evaluation process.

Ah ha – I finally see the pattern – it's a paternalistic, protect the females rule we abide by here – It's perfectly OK to call a male a "no talent a** clown" – it's acceptable for work, is not bullying, and not defamatory – I'm so bored at home right now that I went back and looked – although not scientific and certainly not comprehensive – it appears this blog is OK with "a** clown" comments but not re a female (see the comments a couple a weeks ago). To be clear, you do realize we women are tough enough to take it right? We do not need the paternalistic, implied sexism that you know best for us. Give me a break, I'm female and if you have a comment, bring it on. In fact, I submit, that we are tougher than most it still being the case that we had to work a little harder to advance in our careers. I'm now going back to my cookies and housecleaning and hope you continue to protect me on this blog – not!

Utah Bar just announced no bar exam for this year's graduates. Anyone who graduates this year gets admitted to the bar without a test. Has this happened anywhere since WWII?

If true, what a mess. Adding way more attorneys than you normally would in the middle of a recession. Also, what about candidates that didn't pass previously and are re-taking? Going to auto admit them too?

Wisconsin has allowed "diploma privilege" for quite some time. The rule requires 1) allready be registered for July bar 2) your law school must have an 86% pass rate from 2019. So UofU and BYU are in, others, not so much.

It's a shame the atheists always have to criticize the faith of others. It's a lonely life to not believe in something bigger than yourself, and quite arrogant as well. Today is an important day for many people of faith, do you have such little self-control that you can't shut your stupid mouth for one day? At least identify yourself please. I'd love to know the atheist asshat that I don't need to waste my efforts on, the gesture is clearly lost.

Yeah, I don't go around demeaning atheists. I have no problem listening to my atheist friends and colleagues articulate what they believe, value and why. They are earnest and sincere, and I respect that. These pot shots are just intellectually lazy. There are some atheists (a vocal minority) who think that because they are not religious, they are somehow immune from the pitfall of pride and self righteousness. It's a shame because the overwhelming majority of atheists that I know are very decent, very honest people.
