Dear Judges: Saying in your hearing “I really did not know how to handle this so I asked Judge ____________________ and they said that I should grant/deny the motion” you might believe sounds humble; however it really sounds like you have no idea what you are doing and are just abdicating to another jurist who most likely never actually read the moving papers or examined the evidence.

I would want some more context. Was the issue a substantive one, versus procedural/housekeeping/docket management? Are other grounds stated in the Order that would independently support the decision? Is the standard of review de novo, or abuse of discretion? I agree that the comment should not have been made in open court, and it may in fact provide grounds for appeal, but not without knowing more. I’ve had judges make off the cuff remarks like this from time to time over the years, and usually it is not a huge deal, because of all of the factors above.

Re: Nye County.

According to the Nevada Department of Indigent Defense Services, Nye County had previously been using all outsourced attorneys (only two of whom listed a Nye County address).

This is a pretty common practice for the rurals. Most don’t have enough people with bar licenses living within the county lines to have a full time PD. (Even if they have the budget) so it has to be sourced with private.
Given the comparative size of pahrump it’s a little surprising though.

FYI Nye county is looking for up to 5 additional contract attorneys. Base pay is $200k. If attorney has at least 3 jury trials, they can be DIDS qualified and then get category A Felony cases which are billed at additional $175/hr. You do not need to live in Pahrump for this position

By comparison Clark county tracks pay $66,000/yr and much lower rate on category A cases.

Looking at Ty Maynarich’s Geico complaint, and while not as uh interesting as the Cotton one, I do appreciate he called someone trying to get information and when they asked him his name, he responded “my name was F*CK YOU.” Between the two complaints I can’t tell whether its more likely a mental health crisis or drug problem.

Drug use can be a mental health crisis. Drug use can also bring to the fore underlying mental illness. Alternatively, some people with mental illness (like schizophrenia) will often turn to drugs to self medicate. It’s complicated.

The bar is right to be concerned. But I don’t get the sense anyone is in immediate danger.

It has been mentioned that Ty has no family in Nevada. And the bar is limited in what kind of help they can offer. This is an upsetting situation that many people face outside of the legal profession. Communities step in to help, usually. It’s just a shame that as a profession (and, let’s face it, a guild) we don’t have great ways of helping one of our own.

Mental illness isn’t pretty, and while I agree that some emergency action should most likely be taken with respect to his license, he seems to be more in need of professional help than he is punishment. I think it was inappropriate for Hooge to make any public comment whatsoever at this point.

Some people are mentally ill, some people are dicks, and some people are dicks who are also mentally ill. I don’t think it is binary. Reading some of the statements in the two complaints, it is hard to come away with anything other than an armchair diagnosis of paranoid schizophrenia. This can be controlled with meds, but the side effects can also be brutal, which is why people tend to go off of them.

He’s non hire-able, completely radioactive. Cotton is a long-standing, well-respected med mal attorney. The complaint is absolutely outrageous. My vote is on schizophrenia with bipolar overlay. In my experience with people with this disorder/diagnosis, it’s not uncommon for them to decompensate/go off the rails in the Spring, odd observation, but I’ve seen it now four times. I even googled it out of curiosity when I heard about this instance and compared it to prior instances. Apparently it’s a thing. In any event, he is very much out of sorts and someone needs to intervene right away to ensure that the objects of his rage-filled delusions remain safe. It was refreshing to see his Cotton case assigned to Judge Kishner, she takes no shit. He needs professional help swiftly or this isn’t going to end well. I sure hope he doesn’t have access to firearms. Godspeed to the Cotton firm. Those are some great litigators and fine people that don’t deserve to be looking over their shoulders while feet are a-dragging in sorting this disaster out.

Its “weird” to defend someone who has thrown professionalism and civility out the window, and is publicly filing documents to initiate litigation where he is describing another member of the Bar’s naked body, talking about what a tough guy he is and how he’d kick Cotton’s ass in a fight… this is one sick puppy.

39 is not young, in terms of expected behavior. He’s not a 15 year old boy whose hormones have rendered him illogical and reactive. So weird that Ty gets a pass but other attorneys that have done far less in terms on incivility are raked over the coals over and over again on this blog. As for the comment that someone thought Cotton retired long ago, that’s obviously not someone in his practice area. Regardless, Cotton’s age has nothing to do with Ty being off the rails. At least we know he’s never going to donate to NPR again. The hypocrisy here is so off putting.

8:33 here, I agree with you 8:36, my point was that 5:40 and 9:47 seemed to imply that this wasn’t a big deal and that there was some overreaction by an earlier poster suggesting this was very damaging to Ty’s career trajectory. I do believe this is a mental health crisis and I hope he gets the help and meds he needs to level out and maintain. At the same time, I believe that this blog has been vicious toward others without regard to their mental or physical health for behavior that was way less concerning than that demonstrated in these two complaints. I hope he has some friends or mentors that can intervene here and help bring this to the best resolution possible. Over a decade ago, I observed a close friend go through a very disturbing manic episode that turned very destructive and costly. Mental health is complicated and it seems like the law is such that until a threat of physical harm is made, we just have to sit and wait. Sometimes the harm is the complete abandonment of social norms that impact their future, but it seems the law focuses on physical acts of harm. Very tough. Curious what the Supremes will do here and on what timeline.

It seems like at least one of you posting here has close ties to Cotton (probably a couple of you). Let’s be clear on what happened. Ty M filled a clearly deranged Complaint against Cotton. The Complaint evinces a mental illness. Nowhere in the Complaint does Ty threaten Cotton with physical violence. And we’ve seen no other evidence that Ty has threatened Cotton with imminent physical harm.

I have no ties to Ty. I do feel empathy for people who have mental illnesses.
