Is any attorney out there has character to represent a litigant on ARTICLE III standing against Nevada State and judicial officials based on ROBINS V. SPOKEO case. It is 100% case and Nevada is liable.

Maybe. You have a $10k retainer (earned upon receipt) and a willingness to let the attorney do his/her job? Because it's my experience when someone wants to sue judicial officials, you don't actually want an attorney. You want someone who is willing to advocate whack-a-doodle theories of non-law.

9:39am beat me to it. 9:26am also needs to tell us how many attorneys they have already spoken to about this "100% case".

@9:39 – The Attorney General's office is going to steal "whack-a-doodle theories of non-law" to use in their Motion to Dismiss this 100% case.

Yes, it's free to sign up for. I think you'll find it very useful, in fact, as a practitioner, every time I've found that the colleagues on the lvlawlistserv are never gonna let you down!

@10:15 – would you ever let the listserve down? Run around and desert it?

I don't know enough about Jessup to have an opinion of him one way or the other, but how is he personally responsible for what some rogue guy at the dental school was doing? And if they run someone off after just a couple of years, then how will they ever attract a decent replacement?

It was not just the Dental School (which is just the most recent headline that they are using to justify his ouster). His fundraising has been awful.

This seems like a reasonable off ramp for Sandoval, should he want it, in January.

Irony of Ironies– The Grand Legacy case with the HOAs suing to enforce the deed restriction is in front of Judge Hardy, the same Judge Hardy who screwed up the Lamplight Village HOA case. Lets see how badly he can screw up this case.

Ladies and gents — question for the peanut gallery:

Let's imagine a case is resolved after the plaintiff filed suit but before the defense answers or appears. Normally, the plaintiff would dismiss the case and it would all be over. But let's say that 3 months later, nothing has been filed. Defendant doesn't want to appear and spend money, but neither does he want to let this case sit out there, open and unanswered. He pleads with Plaintiff to file the dismissal, but the pleas are ignored.

What options does Defendant have?

if nothing happens the case will be statistically closed. As long as the Defense counsel has reached out the Plaintiff, Plaintiff can't take a default without a 3 days notice.

Worse case — it's a breach of the settlement agreement / release, or at the very least, a breach of the implied covenant of good faith and fair dealing, for Plaintiff to not dismiss the case.

As long as you have a written settlement releasing all claims, I wouldn't worry about it. If the plaintiff is dumb enough to seek and get a default judgment, then you can move to set it aside based upon the settlement agreement, as well as sue the plaintiff for breaching the agreement and seek fees and costs. Also, was the defendant served, and if not has the 120 days for service expired?

It's a 1 page voluntary dismissal. Don't understand what the problem is.

David Ashley. Neil Smatresk. Len Jessup. All presidents of UNLV since 2006, (plus another Acting President that was in the role for 2 years) and all casualties of the Elected Gang That Can't Shoot Straight. Who in their right mind wants this job? Oh, right. John White.

And now pledges of financial support are apparently being withdrawn. I couldn't blame anyone for doing that. Even if the current guy isn't perfect, you have to maintain some continuity, absent a major Penn State/Michigan State type of scandal. Changing horses every two or three years is a terrible idea.

Elissa Cadish is in Reno campaigning this week, while her calendar is altered, cases dismissed, and orders my office submit languishes. Convenient.

She has bigger problems than that. Kelly is in charge while she is gone. She should not even survive the primary. Please don't vote for her.

9:48 suggests that 8:16 and 8:35 are her campaign manager. Perhaps. But she should should really worry if 8:00, 1:44 and 4:14 are also her campaign manager.

This is what you get when you elect judges. Of course they have to campaign. Get made at the system, not the candidates.
