Frankly, if it were up to me, I'd prefer to have an unlicensed person who is ignorant of the law in charge of the AG's office than someone like Chattah who has suggested that her political opponent should be "hanging from a crane" and believes such invocations of political violence are basically no big deal. At worst, the unlicensed person can claim ignorance of a change in the law and would likely be incompetent. The licensed attorney suggesting violence against their political opponent has made a conscious choice to exchange the rule of law for a reign of terror. No wonder some Nevada Republicans have begun swallowing hard and endorsing Ford for AG.

There is a lot of speculation right now about how tightly controlled some of these down ballot MAGA candidates may be to their national political allies. So even assuming Chattah herself is "harmless", if she is taking orders from the central MAGA nest then she will be as dangerous an AG as MAGA instructs her to be. And Trump is now calling the sitting u.s. president an enemy of the state.

Honestly – if you had just lost your job and had a definite term, but couldn't be fired, would you go in every day from 8-6? What if he was framed? The fact that they haven't arrested him yet makes me think it's not a slam dunk and he is not confessing. And he does seem to have similar build to the construction worker image, but if you wanted to frame someone, he'd be an easy target. Clear beef with German, public figure. hmmm.

I have an approved sale of real property, but the Order has not yet been signed. The buyer, nervous about dropping home values, is trying to back out. Does the estate have a remedy?

You can always wait until the Order is signed and then force the buyer to "buy", with court action if necessary (i.e. motion to compel), but there's plenty of ways an astute buyer (and his/her Realtor) can make the deal all of a sudden not be able to be completed.

See if buyer will agree to a certain amount of credit in the paperwork. This has the effect of keeping the sales price the same on the paperwork, but in reality, lowering the ACTUAL sales price due to the credit, and thus probably won't require a new hearing in the Probate Commissioner. Talk to the title company rep on this because they are the ultimate controller of the paperwork and whether the deal will get funded and then recorded.

Also, what's the buyer got as a down deposit? Vacuum that up if the buyer walks away.

Any new deal will take several months to get in front of the Probate Office due to the unwillingness of the Judges to properly deal with the court backlog for Probate cases, which really sucks. If this occurs, your sales price will probably be a lot lower, and then you might have a cause of action against the former recalcitrant buyer for the difference.

Take a look at NRS 148.300. However, once the judge issues the order and the buyer refuses to close, presuming the RPA is a standard GLVAR form, most buyer's choose the option of forfeiting the EMD upon their default. Presuming they default, and you get the EMD, you could choose to enforce NRS 148.300 for the estate/seller's lower sales price loss after subtracting the EMD. i.e. property ultimately sells for $30k, EMD of $5k, the estate has a $25k claim plus the attorneys fees and costs for having to conduct another sale.

Next time you open a probate, get independent administration. Then you don't have to wait months for an order approving the sale. You send a notice of the proposed sale to the interested parties, wait a couple weeks for any objections, and if no objections then you can close the sale immediately without needing any order of the court. And, you free up the probate calendar from a hearing on your sale.
Getting independent administration doesn't prevent you from setting a sale for hearing if your client wants. But, in our experience, when we give our clients the option of doing the sale under independent administration (meaning no hearing, no bids) or going the traditional route of having a hearing with a chance of overbids, our clients always (and I do mean always) choose to just do the sale on independent administration. Clients don't care about the possibility of an overbid. They just want the sale done as quickly as possible.

@2:46p – which title company do you use for your IA sales. We've had issues with a title company's underwriters wanting that order, even with IA, so have been doing hearing sales, but using FR408 notices.

@2:48 This is 2:46, underwriters are morons. You just have to be persistent and explain IA very clearly so they can get it through their little brains that it is ok. IA has been around long enough that there is no excuse for the underwriters not knowing how to handle it. But, if they insist they won't do it without an Order, take your title business to Driggs Title.

Can confirm underwriters are morons. If you can, push to talk to a lawyer not just some rando title officer or underwriter.

Soooo many times we have an issue with closing and the title insurance/underwriter won't get it, once I get on the phone with a lawyer on the other side it goes WAY smoother.

The scene of the reporters asking Rob questions in his driveway reminds me a little of the Richard Jewel drama. Guilty until proven innocent it would appear. It’ll be interesting to see how this plays out.

I just don't buy it. Obviously, I know very little about what has occurred, and the authorities apparently still only know relatively little at this point.

But unless they have already established a much closer connection to Telles than him simply not liking the articles German wrote about him, I believe that focusing aggressively on Telles may be a real reach(unless, of course, the authorities have a lot more than what has been reported, which is often the case).

But, unless there is some real smoking gun we are not aware of, think about it all for a minute. Telles, in my view, was a decent lawyer and a quite level-headed guy. Let's say that once elected, he did not lead well by example, had an affair with a co-worker, etc. Then when it gets reported, and he loses his re-election bid, we are to believe he suddenly became an enraged homicidal psychopath and gets involved with butchering some reporter?

Again, I obviously concede the big qualifying statement that they may have some really good evidence on him that we don't know about. But if not, it's just too hard for me to believe that he should be some prime suspect merely because he is one of an endless list of politicians who receive some unflattering coverage and then loses a re-election bid.

Every single election years a number of Nevada politicians lose re-election, blame it on shitty and supposedly unfair press coverage, etc. That's suppose to pass as a motive to murder the reporter?

Which is why, as you suggest, the authorities presumably have some real hard evidence, that the public is unaware of, that justifies focusing on him to the extent they currently are.

If, on the other hand, they really don't have such evidence, and all they have is that he resents the reporter for the articles, then this level of focus on him would appear ludicrous.

After all, his previous postings on German seemed pretty tame and demonstrated no real rage or severe hostility of the nature wherein something vaguely of this level could have been anticipated.

He made attempts at tame, wholesome humor(with no real bite of nasty streak of any real sort). Humor like he and his wife were wondering who was rutting through their garbage can looking for trash, and whether it was a racoon or whatever, only to discover that it was in fact Jeff German.

Someone who is that restrained and tame with their statements would hardly seem like a suspect in something so horrible. So, yes, let's assume they know a lot more than we(or even the media) know.

The posts weren't super threatening but they were absolutely bizarre coming from an elected official. They reminded me of the kinds of emails I get from people having mental health crises (which I have to deal with from time to time in my job). Obviously 99% of those people don't murder anyone but I have to say I won't be surprised if the stress of the situation caused him to have some kind of psychotic break.

I am 12:17. I take no pleasure in predicting that Telles would try to kill himself but that is my guess. All the emergency vehicles, stretcher, etc.. Once again, anyone that would be so bothered by bad press must have a troubled or fragile mind in some way. For example, I was featured in an article once in a bad light (not by Mr. German), and I was extremely embarrassed and held my head low in Court, but not once did violence pass through my mind. For those curious, it was nothing heinous, just a personal, non-law relate mistake that I made during my divorce.

Many times journalists will say an arrest is based upon “suspicion” because the formal charging documents have not been released and it’s just probable cause to believe a crime was committed. Furthermore the RJ is effectively a party to this story so I would imagine they are attempting to be judicious.
