RIP Jeff. Good man.
Def RIP. Our loss.
Seems like something more is going on than just some random stabbing.
The alleged killer looks like a nursing home crossing guard resident. I am sorry to German's family. That is a loss
There is construction work going down on Vegas Drive right outside of German's residence. While LVMPD indicated that they believed that the person was casing multiple residences, this looks like a targeted job to me where the guy dressed to camouflage with the surroundings and then blend right back in.
As a person who has made the front page of the RJ twice care of Mr. German, I can tell you that he did not deserve this. He always treated me fairly and would always reach out to let me know what he was going to say. It definitely sucked to be the focus of Jeff's articles, but he was factual and thorough. I wish his family my sympathy, this too sucks.
I am not willing to be as public as Ben but I have also been the subject/quoted in some German articles. He had a tendency to take the prosecution at their word and to basically print the press release; however this is a flaw in the trade of reporting court proceedings which is that the prosecution has a predilection to say as much as possible while the defense is often saying as little as possible.
Hey RJ– if you want people to help provide information in the murder of your co-worker, maybe dont put the stories behind the paywall. Just a thought.
Between us. The Brave Browser with the Brave Search Engine does not get caught in the paywall. I read the RJ everyday now a days.
I just downloaded and Oh My! I am now reading the Wall Street Journal without a subscription! I'll need to try the NY Times and WAPO too. Thank you!
They both work…..without subscription.
Shhhh.
4:06 is probably trolling – but no one thinks this order is legally sound. Even Bill Barr said "It's deeply flawed in a number of ways. I don't think the appointment of a special master is going to hold up." Also, it's not Magistrate Cannon, is US District Court Judge Cannon.
The court's assertion of jurisdiction is suspect – equitable jurisdiction does not authorize a court to enjoin a criminal proceeding out of the executive branch (particularly when no proprietary interests are at issue). equity offers no relief to those who come into equity with unclean hands. This is a basic principle of equitable jurisprudence, and although it is a defense, in equity there's overlap between "jurisdiction" and "claims" and "defenses" and "remedies." It's not fallacious in equity to say "there's no equitable jurisidiction to give such a broad and unenforceable remedy," or "there's no equitable jurisdiction because the plaintiff has unclean hands." These categories are just more porous and overlapping in equity (as discussed in detail in Bray and Miller, Getting Into Equity—see the metaphor of tags rather than a hierarchical file system). If Trump commingled personal effects with classified documents, that is not a reason to allow him to restrict use of the government's property – it is a reason to deny him any relief. Of course, none of this was briefed by Trump (or his attorneys), instead, the Court argued these positions on Trump's behalf. I mean – there is not even an actual complaint on file – just started with a motion that wasn't filed or served correctly.
In addition to many procedural problems that the court simply overlooks, it appears Judge Cannon is trying to control the executive branch's investigation and potentially stop it from possibly violating Trump's rights. But it's clear that Trump is no longer entitled to executive privilege and that the warrant was issued by a federal court – making the warrant a court order. The filter team has already segregated documents potentially subject to attorney-client privilege claims and the DOJ has already reviewed the remaining documents. Under our system of separated powers, Trump's alleged rights have to be dealt with ex post, not through an injunction. LA v. Lyons, 461 US 95 (1983).
A few additional case cites: "Prospective defendants cannot, by bringing ancillary equitable proceedings, circumvent federal criminal procedure." Deaver v. Seymour, 822 F.2d 66 (DC Cir. 1987) (Silberman, J.) (rejecting civil suit to enjoin govt from indicting plaintiff); federal courts generally lack the power in a civil action to enjoin the executive branch from prosecuting a criminal case. See McPhee v. United States, 2021 WL 5014815 (SDNY 2021).
Just spitballing conspiracy theory level here, but Abbi Silver mysterious resigns, German looks like he was purposely taken out… Are we seeing a new scandal ala the HOA thing with Quon and Amesbury and Saitta?
Would anyone be surprised?
Would this conspiracy involve Rob Telles? RJ reporting cops searched his house in connection with this:
https://www.reviewjournal.com/crime/homicides/police-search-county-officials-home-in-connection-with-reporters-killing-2635486/
That would be the backseat hanky panky guy.
Holy Eff. I just saw this RJ Article.
Whoa. And a vehicle matching the vehicle of interest just happened to be parked in his driveway.
Associated news: The OBC will continue to pursue SOLO practitioners who are off 99 cents in their trust account (yes, this really happened, see their magazine) and ignore Telles who actually may have murdered a reporter
Wow. Telles. Unbelievable.
Wow. And when are people going to stop driving their own cars and carrying/using their own phones when they go out criming? Get it together!
I can think of a few judges who are scams
