I know we don't have all the facts, but does someone get a manslaughter charge for this? Is it the person who loaded the gun, the one who handed it to Baldwin, or Baldwin himself?
I can already imagine that the civil suits that will go against Baldin, the propmaster, the studio.

I'm not a criminal-law lawyer or a New Mexico lawyer, but I don't see how Baldwin could have the mens rea for even involuntary manslaughter. Seems also that excusable homicide by misadventure could apply?

The prop master seems like he could be criminally liable, depending on the facts.

I do not know anything about Baldwin's knowledge and experience with firearms, but to me, pointing a gun at anyone and pulling the trigger NOT AS PART OF THE ACTING is reckless at best. That makes this involuntary manslaughter at a minimum. Read Andrew Branca's analysis.

Were there any charges/lawsuits that followed Brandon Lee'a (Bruce Lee's son) death on a movie set. That is the key. Does anyone know. Andrew Branca's analyis–link please.

Answered my own question–no charges in the Brandon Lee case but different facts than Alec Baldwin.

Togliatti joining the Gaming Commission makes me wonder if between that and ARM she has abandoned the thought of the federal bench.

Probably? Really sucks that her nomination didn't go through, she would have been a good federal judge.

I am not the BlogMaster Law Dawg but there was a comment on here discussing the consideration of criminal charges in the death of actor Brandon Lee as an analog to the Alec Baldwin situation. No politics in it. It got removed. I respect the job that you do but might you sometimes get a little delete happy?

You're correct, that was my mistake. I took that comment down inadvertently while sifting through the muck. My apologies to the commenter.

How is discussing the possibility of sanctions against political parties for advancing bad faith litigation not a legitimate topic for the blog. Some of the comments obviously went off the deep end, but the original post was fair game IMO.

The discussion was a long, slow, annoying slide into the same political back and forth bs that we do not want or need on this blog. It would require far too much of my time and effort to determine exactly where I thought the line from legitimate to trolling was, and I'm sure even if I could find that line, many people would disagree, so I just nuked it all. Please note, I would would (and will) do it again! NO RAGRETS, TROLLS!

Okay, that was a meme from years gone by, but the idea is the same. I'm as guilty as many of bringing national politics to this humble local law blawgs. Sorry dawg. Will do better in the future.
