The victims of Bernie Madoff and his ill fated Hedge Fund got their money back or a substantial part of it. They went after anyone who made money who invested with Madoff. In the Graham case it is a little unclear whether the victims that were ripped off or never paid will get their money. The perpetrator is Rob Graham. He lived beyond his means and squandered their money. This is more like an "American Greed" story where the victims seldom see a dime but attend the sentencing of the perpetrator. The State or Feds can charge him separately for each offense that he committed and stack felonies upon felonies. He could be sentenced to an incredible amount of time. But this won't happen any time soon. It is going to take a while for the State and Federal to piece this together and build a case. The process could take two years or more.

Can you give an example where someone was disciplined for being off a nickel or making a simple accounting error? I here people complain about the state bar, but I have not seen someone get disciplined for accounting errors, unless I am just missing that Nevada lawyer.

@4:56– I can cite you to an example, although its a Private Reprimand and obviously am not going to out my colleague. Monies come in for 2 clients, say $100 for Client 1 and $1000 for Client 2. Attorney reverses the amounts collected for the 2 clients and releases from IOLTA Client 1's monies ($100) to Client 2 and Client 2's monies ($1000) to Client 1. Of course when the mistake is realized, Client 1 is not giving back the $900 windfall, while Client 2 is furious as to where is his money and goes to the Bar. Attorney makes it right out of his/her pocket. Private Reprimand on Attorney's record and audit of Trust Account after hours of having to deal with SBN.

The Bar wastes so much goddamn money congratulating itself and the few busybodies who think it's so important to attend each and every lame State Bar circle jerk. Cancel all these waste-of-time "events" and reimburse the victims. It would be a far better use of the money that the majority of us flush down the toilet each year. Think about it; do all the State Bar asslickers really need yet another free vacation? Plaque? Banquet?

We elect said asslickers. The problem of course is that it's the same people, or type of people, running year after year. I probably haven't bothered returning a ballot in a decade. Maybe I would if there were a "burn it down" slate on the ballot. Not holding my breath. It's like a student council election.

Some of the highlights of our beloved state: Of the $500 or so that lawyers pay, $25 goes to the Client Security Fund. Each year, that makes about $200k that goes into the fund. Payments from the fund have been around 273k / year, with a $50k cap per claimant. In 2013 alone, the CSF approved $517k worth of awards.

Looks like Rob Graham wasn't the only one running in the red. My guess is that the CSF is nearly tapped out, and Graham's clients are going to get screwed. Again.

I think 10:00 hit the nail on the head. If memory serves, in the Madoff situation, a handful of investors did quite well and the government was able to assign them co-conspirator status, seize the funds and distribute them later. In Graham, there is no such dynamic. The clients are individuals, many of whom may be elderly and ill, who have now been reduced to abject poverty and unrelenting misery, for whatever remains of their lives, and now unable to afford critically needed medical care, etc. They will be forced to rely on lame ass GoFundMe accounts, with perhaps some limited help from the State Bar fund that reimburses victims. In the end, most of them will receive either nothing or just pennies on the dollar. Another possible source for some of them may be the LDS church. Graham is LDS, has significant connections in that community, I believe he advertised heavily in LDS publications and websites, and apparently received a lot of referrals within that community, etc. So, a certain percentage of the victims are probably LDS, and the church has traditionally been quite generous in assisting active church members who encounter life-changing, very serious events.
This certainly qualifies. It is really impressive how generous the LDS church often is in such situations

I would like to take this opportunity to express my displeasure with the lengthy thread on yesterday's blog which consisted of a couple posters who made no mention of the victims, but bemoaned the dreadful effect all this must be having on Graham's immediate family–totally ignoring the fact that it can be presumed the family benefitted to some meaningful extent from the pilfered millions by enjoying a greatly enhanced life style. But the posters(again, while making no mention of the victims) waxed sadly and dramatically about how dreadful this all must be on Graham's wonderfully pious family, how we all hope they bounce back, etc. Trust me, they will bounce back a million times better than the victims will. For many victims, their quality of life is greatly diminished, and in many cases utterly destroyed. I believe those posters need to reflect on their priority system.

Amen. Hallelujah. Sadly, I think their priority system is centered around their "affinity" for the Graham family and closing their circle. There is no reason to punish members of his family for his actions. However perhaps they should not be first on the lips of your prayers on Sunday.

Now that there is an involuntary BK filed – just watch the numbers of claims that get filed. Everyone stand in line – it's going to be a matter of whose matter is a higher priority than others. It's going to take months and maybe a year or more to ferret out what is otherwise his creative accounting. And we don't even know what the IRS is going to say when that comes to the surface – cuz it's going to!

Neither – Garman Turner Gordon. He does have a connection to an attorney on the BoG because they were at Gordon & Silver together so it could be how he got involved.

That is NOT how he got involved. The Macknin case is the one that brought this to everyone's attention. Macknin is being prosecuted by Sid Kistler. While Sid is with Hutchison & Steffen now, Sid spent years at Gordon & Silver. Sid knows for a BK of this size the caliber of BK Counsel that will be required and enlisted Gerry Gordon. That is why Macknin is listed as the first creditor filing the Involuntary Petition.

All these conspiracy theories above seem to be ignorant of how an involuntary bankruptcy case actually works. In another article on Friday that people presumably also did not read closely, Beesley set a hearing for this Wednesday regarding the appointment of the trustee. The United States Trustee–not the State Bar, not the judge, not the Stonecutters–picks a panel trustee to oversee the case. This panel trustee and the counsel they choose will perform most of the work in this case. Gordon's involuntary got this process rolling.

First, the content of the emails. The content has not been disputed. The mainstream news outlets are advocating that it is better that lies and deception are used to win an election rather than a fair hearing of factually relevant information. Clinton stole nomination from Berney, but no one seems to care. Why?

Second, where are the facts? CIA says they "have reason to believe." Really? The FBI says, we got nothing. Go with FBI on this one.

Trump won because he was the better candidate. The endless media campaign against him failed. Trump defeated the entire media elite, hollywood, DNC terrorists, etc., and the notorious H.R. Clinton. He will go down in history as one of the greats.

The important issues are this: the Republicans nominated Donald Trump. This should have been a walk-off home run the Democrats. Donald Freaking Trump. Run a competent campaign, and it's over. So, ask yourself. Just how shitty of a candidate did the Democrats nominate that she couldn't effectively eviscerate Donald Trump? That she couldn't persuade people that her position was the better one? She's a lawyer. She was SecState. You're telling me she was unable to formulate a persuasive reason for people to vote for her? She did run a competent campaign, and more people voted for her than Trump. That she lost the election because Trump won more electoral votes is another issue – Clinton didn't win enough votes in the states that mattered. Russia and the Russians are not irrelevant – just because they didn't cast a single vote in the US election doesn't mean they weren't actively working to affect the election – something a real American would find treasonous to support or ignore, but a typical Faux News'er can't help but repeat. This obviously was never going to be a typical election – look at the primaries of both parties – Trump never should have come close to winning, but he did, and Sanders never had a fair shot.
