I don't know, while i have been and continue to be ill at ease with the politicization of these appointments, i feel equally uncomfortable with the rising trend of the retiring judges wanting to be part of the appointment process on a successor. In this do we have to wait for a judge to become senile and be on death's door because the administration at the time didn't want to choose their person?
I 100% agree. I like Rawlinson, but I don't think it's her place to dictate who her replacement is.
I agree about the politicization, but I especially agree regarding choosing a successor. It seems like, if you read between the lines, she'll stay on the bench unless the independent commissions choose her her chosen successor. Not a good look
Rawlinson wanting to choose her replacement reeks of arrogance and entitlement to me, in the sense that she believes she's above the (should-be) non-political nature of her job. Definitely not a good look. But, she doesn't care, and neither will our two senators. She'll get away with it, scot free.
Didn't Aron Ford, and by extension his wife too, have a tax lien recorded against their home? Paying one's own taxes should be a minimum qualification for anyone to hold any public position.
Welcome to the 9th Circuit Court of Appeals shithole. They are as inept and biased as can be.
Hey, @2:22, they (and by "they" I mean Robert Eglet) paid that tax lien off!
OP Here,,, @2:13, i hate to say,, but if we read the tea leaves you are probably all the way correct on this outcome.
3:03, yeah, it's degeneracy not to pay your taxes to the point of the IRS liening your property. Sounds about right that someone like her would be appointed to public office in this bass-ackward country we live in.
Berna is a nice lady, but the 9th Circuit? NOOOO! She's applied for vacancies on the EDJC several times, and never gotten through the vetting process. So now she gets to go to the federal appeals court? Say it ain't so, Johnnie B.
Berna is utterly unqualified for the 9th Circuit. However Johnnie R. was utterly underqualified for the 9th Circuit. Compared to Bybee who had stellar credentials and Van Dyke who was a completely political (w)hackjob but had credentials, the suggestion that Berna is in open discussions with a sitting judge for her seat is terrifying.
Johnny Rawlinson is completely out of line. This shows you how fucked up the ninth circuit is. They make the Nevada Supreme Court look good. A complete abuse of power.
I am of the opinion that any Class action lawsuit against Wells Fargo and Beasley and his buddies should name the SBN for disgorgement of any IOLTA funds received. They should've known too.
That would be very interesting.
A justice court candidate should not be accepting iplta and pac donations.
Care to elaborate?
Pull election reports for April, a candidate for justice court 7,8, 9 or 10. You will see.
Which pac?
Why is a justice court judge take pac money? That is only for Cadish or Wolfson
Soros is everywhere.
I'm not prone to weird, supernatural conspiracy theories, etc. But when I look at Soros he really looks evil to me. Just a thought.
Hey law dawg – 9:33 needs deleted.
Quick question for family law attorneys. I just filed a motion in a divorce case and included the HEARING REQUESTED language in the caption. Will the family court automatically assign a hearing date and file a Notice of Hearing or do I need to do something else to get a hearing date?
You don't need to do anything further, the court will set a hearing date
Finally someone asked a question for me. I've been FL my whole career! awwww man 12:41 is correct. The Court will set a date and you will be served a Notice of Hearing. Additionally, the opposing party may not be set up to be served electronically so don't forget to serve and file your Cert of Service. Even if they are setup I still file a COS showing the electronic service. Not sure if that is required but I do it anyway. Any other questions. It sounds like you might be new to FL. We're here to help seriously.
I read "FL" as Florida. I read your post twice trying to figure out why you were giving advice on how to file in Florida.
haha no sorry – I meant Family Law
In theory, the Clerk's office will notice the Hearing Requested language and assign a date automagically. In practice, schedule a tickler a week out. If they still haven't set a hearing, file a Notice of Hearing. Then you get to serve both the Notice of Hearing and the brand-new Clerk's Notice of Hearing all at the same time!
