This is part of Sirius XM Customer Agreement dated 10/14/2021. Their success rate with recent class actions may have prompted this. Any comments? Would you allow your General Counsel to try this tactic? Just wondering.

7. Class Actions and Severability: You do not have the right to act as a class representative or participate as a member of a class of claimants with respect to any Claim submitted to arbitration or litigation (to the extent you elect to Opt-Out of Arbitration) (“Class Action Waiver”). A “Claim” does not include any challenge to the validity and effect of the Class Action Waiver, which must be decided by a court. There shall be no right or authority for any claims to be arbitrated on a class action basis or on bases involving Claims brought in a purported representative capacity on behalf of the general public, as a private attorney general, or other Subscribers, or other persons similarly situated. The parties acknowledge and agree that under no circumstances will a class action be arbitrated.

Ran into one of these the other day. Have become pretty standard I think. You pretty much wind up giving up your rights whenever you sign up for one of these services, and these clauses tend to be upheld most of the time.

Great. So a jackass in an overpowered sports car kills someone and now there's an epidemic of speeding so those of us that drive 10 over are going to get flooded with tickets. Yay.

It's fun during rush hour to drive west on Sahara or Charleston and see the line of motorcycle cops on the overpasses. I'm sure metro and NHP can justify targeting commuters on the freeway for going a few over while property crime downtown is out of control and they repeatedly, over and over, tell us there's nothing they can do.

Oh and the domestic violence…that's a civil matter ma'am. Sorry you're covered in bruises, but you'll have to take it up with family court. Metro has to focus on speeders.

Ahh… you are forgetting that ticket fines are the main source of revenue to the City for offsetting the cost of Municipal Court.
Besides, sitting on the overpass is much easier duty than rousting a homeless person threatening someone with a knife. Nevertheless, I favor ticketing on the 95 and 15. Seems like some jerk is getting into an accident every week resulting in shutting down the highway so that it takes me an hour to get to work (late).

Waiting for the products liability suit against Toyota. Fuel tank design allows ignition on rear impact, etc. etc. Reminiscent of the Ford Pinto cases in the late 70's. Noted that the Pinto leaked fuel on a 30 mph impact, while Rugg impacted at 156 mph. Still, there may be an argument that a splash guard or adding a frame member could have kept the car interior from igniting or at least delaying it.

If I am on the Ruggs criminal jury I am probably going to weigh "free Uber 24/7 for all NFL players" against "dead from dui impact at 156 mph" and call it a night. The rest won't matter.

For any civil suit I would just be adding commas and zeroes for every frivolous defense they throw at the wall. The publicity is not doing them any favors. Is Gruden making the calls for his defense?
