A small number of repeat offenders cause the vast majority of the DUI fatalities, and they are routinely released unto the streets because incarceration is a drain of funds, whereas handing out DUIs with associated fines and fees is a for-profit activity. The system is meant to harvest funds, not reduce DUIs.

Tracing to the establishment smacks of dramshop rule enforcement — yay, more fines and more money for CC. Make it rain — and don't save one bloody life in the process.

Since NRS 41.1305 generally immunizes bars from civil liability, what exactly is the county going to do if it traces a bunch of drunk drivers back to a certain bar? Sounds like they're contemplating yanking their liquor license, but for what?

Or are the cops going to basically stake the place out or do a sting or something? Would hurt business no doubt, but I presume those patrons would just go somewhere else and it's whack-a-mole forever.

@2:55p – maybe treat a bar that has a lot of patrons leaving drunk and causing DUIs as the same as a bar that has a lot of police calls for disturbances and fights. So yes, whack-a-mole it will be.

I was out with friends a few nights ago. At the bar this one man was so belligerently drunk I felt compelled to keep an eye on him just in case. Sure enough, a few drinks later he starts wandering towards my group, just as I am getting up, staff gently suggests he leaves. He agrees. As he is leaving, a patron shouted: "drive safe." He smiled, waved and left. Not a chance he was capable of driving safely. And everyone at the bar knew it.

What would/should/could the CC inspector do in this situation?

Even better, what's the bartender and other staff supposed to do?

I think the bartender is supposed to cut the drunk off whenever he becomes visibly drunk.

Although we don't have dram shop, it is illegal for them to serve someone who is obviously intoxicated, which could jeopardize their liquor license. I think the tracing is just a way for them to begin putting the fear of God into some of the places that are serving too many drunks, if they start to see a pattern.

Michele Fiore is not going away anytime soon. For the foreseeable future, however, her situation is challenging because her fortunes are so closely tied to the fate of the conservative/Trump/Republican movements. Those movements are going to make a comeback. You can bet on it. And when they do, MF will be riding the crest of the wave. Some commenters her underestimate her political abilities. She is a relentless gladhander, campaigner and socializer. She has built up tremendous goodwill with the people in her base. She will be in and out of public office for as long as she wants. She will never be governor or senator, but I would put basically everything else on the table for her.

I disagree with 11:58. She is a more buxom Sharron Angle. Fiore can go to Nye County and crazy her way around the town but she is done as a statewide candidate or even a candidate for any office in Clark County. The scarier thing is that it appears that the most popular candidate for the JP position is Leo Blundo who is just as crazy as Fiore and was accused of choking his wife.

12:37, 11:58 here. It's easy to compare Fiore to Angle because they share insane political beliefs. Beyond that, they are very different in more ways than their "buxom" status. Fiore has far superior interpersonal skills and is a gifted retail campaigner. When the tides turn in favor of the far right – and they will – Fiore will find herself in elected office again.

As for Leo Blundo becoming JP, that's on brand for Nye County- Nevada's island of misfit toys.

Joe B. Jr's election to LV JP did the same for creation of a 5 year JP rule – the Joe Jr. rule. I guess maybe we'll get a Fiore rule for rural counties.

I am livid right now. I am as far from "woke" as can be and do not look for things to be victimized for. But I just went to drop my German Shepard off at the groomers and while there saw a male dog humping a female dog. The staff were laughing. I thought, as a big animal lover, how pissed I would be if I owned that female dog and some dog was doing that. I don't want to minimize the word "rape" but WTF would you call it. I'm just wondering if I am just pissed because I didn't get a big bonus or if that really sucks at the groomer. Thanks for letting me vent.

Hahaha that’s have no idea if that’s true but it sounds funny – but what about property rights? I’m divorce lawyer so know dogs are viewed as property so what if gets pregnant? How were groomers caring for owners property?

@1:38 Given that the groomers facilitated the intercourse during the period of their bailment, as their counsel I'm arguing they are entitled to a share of the proceeds for all puppy sales.

Well, let's see. We have two-time judicial race loser Leavitt, whose temperament is dubious at best and whose legal acumen is just…underwhelming. We also have Morton, who as the prior poster perfectly pointed out, is best known for her siniour positon in her solo practice. Then we have Moors, who has had an exemplary career as a criminal prosecutor. Tough choice.

Moors has had an "exemplary career as a criminal prosecutor"? She's been practicing 10 years and has limited trial experience and ZERO civil experience. She's barely competent at criminal, which is her only area of practical experience. She's definitely not someone I'd say is suitable for judge. All 3 are horrible options. Of the 3, I'd probably [reluctantly] say Nadine.

The problem with applying for these is that you have to immediately begin begging for money and hitting the rubber chicken circuit, and even then you have a better than even chance of getting taken out in two years or less. See, Atkin, Trevor, and Roohani, Ellie.

James Dean Leavitt is a solid criminal practitioner. He did a lot while serving as a Regent, including heading up the effort to create the med school. Leavitt would be a good judge. Morton is an extremely weak practitioner. I don't know anything about Moors.

According to Leavitts public app he worked for Galatz, Earl, Catalano @ Smith and then worked for Goodman @ Chesnoff. Private practice for 28 years and led the effort to start the UNLV med school and 2 years as Chairman of the Board of Regents. Sounds damn impressive to me.

Leavitts last misdo trial was a NOT GUILTY verdict – why criticize him for not having done a jury trial. Clients choose to plea bargain their cases – if a lawyer consistently gets deals that clients accept – that is not a valid criticism. Lots of haters on this site. I have watched him be interviewed by Jon Ralston several times over the years. He is one passionate, sharp dude.

We need judges who understand litigation. We need people who have written motions, done trials, filed appeals, argued appeals. This is a lousy group of prospective judges. The D.A. is the only arguably competent person in the group, and I'm not certain she's all that competent.

No one is going to confuse Leavitt with Learned Hand or anything, but he is decent and fair minded, understands the law, and is unlikely to morph into a holy terror once the robe goes on. Maybe I'm setting the bar a little low, but that's good enough for me right now.
