Congratulations to Justice Ron Parraguirre, Judge Linda Bell, Judge Michael Gibbons, and Judge Bonnie Bulla on drawing no competitors in the election for Supreme Court seats E, A, and Court of Appeals districts 2 and 3, respectively. The only statewide judicial office that will be contested is Court of Appeals District 1 where Chief Deputy Public Defender Deborah Westbrook and Judge Rhonda Forsberg will vie for the seat previously occupied by Judge Jerome Tao (who did not file for reelection).
At the local level, congratulations to Justices of the Peace Harmony Letizia, Melissa Saragosa, and Amy “JoAnne” Chelini who will all be retained without contest.
The confirmation hearing for Ketanji Brown Jackson starts today. [SCOTUSblog]
Kaskade and his nameless lawyers win $8m in Kaos suit. [RJ]
A question from the comments on Friday–“EDCR 2.20 states that an Opposition that contains a motion is a countermotion. It states that the moving party’s reply is due 7 days before the hearing. Is an Opposition to Countermotion (which is really a reply) due 7 days before the Hearing or 14 days after service of the Countermotion?”
Honest question. What is it with men and their secretaries/assistants? Why can't a man hire a female assistant and have a normal working relationship without impropriety? It seems like an epidemic, particularly with married lawyers. I learned several months ago that a well known and well respected [married] lawyer here in Vegas that I've known for 15+ years has had an ongoing relationship with his college aged secretary who is MANY years his junior (and frankly, isn't the slightest bit attractive). And this isn't his first fling with an assistant in recent years, same thing with his old assistant. Is it a power thing? Ego? Low confidence? Desperation? Help me understand.
Why the age shaming? We live in a society where same sex, all variations of fetishes, inter-racial, etc. are acceptable with the underlying principle being – let people live how they want. I'll be frank that this hits home with me. I'm a 58 year old white male. My long-time (over 10 years) girlfriend is 35. So what? I love her and she seems to love me. I know I will probably Pass before her and have made financial arrangements to protect her. I am not picking at you 10:03. I actually detest people who cheat. But I am curious. Is your criticism well-thought out an legitimate or was that just a knee-jerk ewwwww kind of thing? Thank you.
The vast majority of men with female subordinates do have normal working relationships. Morality aside, most men in high power jobs would see how stupid doing something like that is. Don't confuse a few horndogs for the rest of us.
OP here. I am more concerned with the cheating and the employee/employer dynamic than the age difference. Generally speaking I have no issue with age gaps in relationships. In an employer/employee setting, the unique relationship between a boss and an employee does not make for an equal partnership. It paves the way for a relationship with some difficult and problematic exchanges and interactions. Throw youth and inexperience into the mix and it seems like a recipe for disaster–very frightening and uncomfortable to say no, increased chance of exploitation, etc.
I'm not sure this situation(involvement between employer/employee) is a major power dynamic, nor do I think that a great age differential is usually a feature of these types of relationships.
Those two factors may sometimes be present, but I think the main explanation is a lot more mundane. Opposite sex people who work together are spending a lot of time together while at work–something that would not occur outside the work environment without attracting a lot of attention and even conflict.
In other words, they have the opportunity on a silver platter, and if they can confine the affair discreetly to the work premises, they can often go undetected by their spouses-something which could not realistically occur if they were spending a lot of time together outside the work environment.
Don't know what this means, if anything. But I read (from memory, paraphrasing) that there was a study where X number of people volunteered. They were paired up and each told the other deep secrets about themselves. According to the study, a high percentage ended up dating and a couple got married. What I took away from that is that often when people are put in close contact, they grow to become interested in each other. I think back in my life and I learned to like (not romantically) people I would not have dreamed of liking had we not been thrown together. Probably TMI but I grew up in a very racist part of the country. When I went to college I was forced to spend a lot of time with a black guy in my major so physical therapy. He actually became my best friend all through college. Not sure if that would've happened had we not been thrown together.
This happened between some old co-workers of mine. Didn't end well. Both were fired. The married one (female) ended up divorced and later took her own life. Nothing good can come from this situation in my opinion. That doesn't seem to stop people though.
What is the cause of women attorneys and their female assistants having clashes. Despite all this stuff about equality in the workplace, women subordiantes seem to prefer to work for a man. A lot of women attorneys have trouble with their staff.
If you ever wonder why there are firms in town where all the attorneys are religious, this is why. The turbulence and instability that come from sexual impropriety and substance abuse is bad for business. Clients like knowing their lawyers are teatotalers. And I will acknowledge that religious people have affairs and substance abuse problems too, but at much lower rates. And non-religious people can and do avoid substance abuse and sexual impropriety. I know this comment is going to get hissed and booed, but I make it anyway. I've worked almost all my career with religious attorneys and have never seen a substance abuse problem, a sexual abuse of power, or an extra marital affair. Sometimes, the Ned Flanders way of life is the way to go.
7:22 read what I wrote carefully, I was listing relationships that once were unacceptable but are now acceptable, I never suggested anything of the sort. In fact, I agree with the tone of your post. I was trying, inarticulately I guess, to say that it seems society has grown more tolerant except of age differences. Even your post, suggests she cannot be happy and has a cabana boy. I just find it curious how society picks and chooses. I guess if us older guys had an Old Guy Pride Parade or a lobby in Congress, it might change. Have a good night, us old dogs gotta get some sleep.
The comments of the last few days have been eye opening. Thanks for the blog. Our profession is more sociopath and borderlines criminal than I thought. It puts things into perspective for me. As for shark pimp, you date who you want. My daughter would not go out with 70 year old. I have no idea what fetishes and lobbyists have to do with it. You want pooch. Stop trying to make it a cause.
Looks like Judges Bert Brown and Cynthia Leung did not draw opponents in LV Municipal Court. Also, Judge Hoeffgen in NLV Municipal Court did not file for reelection.
It was time for Hoeffgren to go. He does not have the temperament to be a judge.

10:23– I would postulate that your post shows exactly the problem. We live in a society where same sex and interracial relationships are looked at the same way as "all variations of fetishes". Bless your little heart for being open minded enough to save that young woman.

PACER says the Kaskade lawsuit had Snell & Wilmer briefcase carrying for the Plaintiff (also represented by Reed Smith out of NY), and Campbell & Williams for the Defendants. Judgment was $7.95MM before attorneys fees and costs.

The Opposition to a Countermotion is due 14 days after service of the Countermotion. The reply is separate.
Practicality dictates the opposition to the counter motion be filed at the same time as the reply, if for any reason than to get it filed before the hearing. That said, countermotions create such a mess given the hearing date has already been set on the original motion.

@1:03pm well said! Spoken like a true sexual deviant!

I'd rather know, what is with married male partners and single female associates (later getting promoted to partner)?
