I am going to guess (without Googling so if I am wrong I am wrong) that it is some form of Western States Bar conference? I have no idea and have to admit that if it is a big deal or involves spending any of our bar dues that the SBN has done a terrible job of promoting it.

I followed the link to the Bar web page for the conference. No information about the “What” or “Why”.
…and No, the SBN did not send me a notice or otherwise provide advance information to me … and probably not to you either.

Kemp Jones lawsuit says losses to Ellis Island Hotel are in the millions from F1 race. The interesting part of this case is that Ellis Island was thrilled to have F1. Located next to the paddock area and promised millions in business from the guests that would be generated, Ellis Island was exactly the businesses that F1 was supposed to help.

Kemp Jones will take the F1 folks to the cleaners. I got stuck in the Ellis Island F1 traffic mess twice. Stuck for hours. It took me hours to get home. Awful.

Because this is a legal blog, can anyone point to a cognizable cause of action here? Tortious interference with prospective economic advantage?

Doesn’t the fact that this was permitted by the County Commission kind of vitiate this claim?

Without doing any research, my instinct is the same as yours, local government approval, conditions and supervision will provide a defense.
F1 approval always looked to me to have been too quick, too easy. Suggestion: follow the money to the County political folks and Convention Authority officers.

I believe that I read in the story that they suing for a “taking” in the restriction on the use of their property in blocking any guests from being able to enter their property. Therefore the claims are (1) Violation of NRS 41.800 for intentionally obstructing roadways and ingress and egress; (2) Dec Relief; (3) Intentional Interference with Contractual Relations;(4) Intentional Interference with Prospective Economic Advantage; (5) Regulatory Taking; (6) Inverse Condemnation and related condemnation damages

I read the complaint. It alleges various takings/condemnation, interference with prospective economic advantage, as well as that the approval process was improper in that no special use permit was required when it should have been. Randall obviously (and as one would expect from him) put considerable thought into this and did not go off half-cocked. It is in Business Court, in front of Kishner. Not sure that would be my favorite place to be, but I just don’t like her as a general rule. His relationship may be better. The motion practice should be interesting to follow.

I don’t think his relationship is better with her than most practitioners. I do suspect he will not take her crap like most of us do. I heard Steve Peek with Kishner, and he gave her the amount of deference that she deserved.

I hate the way that F1 came into town and just bullied everyone, showing zero regard for employees, but especially the small businesses. I hope that Ellis Island absolutely fucks F1 over hard. Is this gonna go to a jury? If so, F1 is even more fucked. We all remember how they acted.

F1 was awful. The traffic was miserable and the county wouldn’t do anything about it. I echo the comments hoping this goes to a Clark Co jury. Fuck F1.

F1 is gonna learn the hard way exactly what a Clark County jury is capable of. I hope Ellis Island isn’t the only one who goes after F1.

I’m not a fan of F1 (the actual sport), zero interest. Is the kind of condescension and pushing people around typical of the culture of the sport? Is this a European thing?

I’m reminded of a quote from County Commissioner Pat Webb. Commissioner Webb was before the time of most of you. “[F1], you people never will understand the way it works out here. You’re all just our guests, but you act like you’re at home. Let me tell you something, partner: you ain’t home, but that’s where we’re gonna send you if it harelips the Governor. Thank you for your time.”

Ellis Island should probably just call Jeremy Aguero. He can set them straight and let them know they actually made millions of dollars as opposed to losing millions.

This is the same story for all sports teams who receive goodies from the government – the owners and sports organizations win and the community loses. Sometimes a few lucky community members win, but only at the expense of other members of the community.

But don’t believe your lying eyes, or the mountains of research on the topic, trust the promises of the sports teams and their paid lobbyists.

This is a very underrated comment. Jeremy Aguero is like a lot of the “experts” we hire in litigation, a credential whore who will come up with whatever half-baked “analysis” you pay him to put together.

I know I lived there for year while clerking for Supreme Court. Adele’s was the only decent restaurant and the highlight of my week. in 2019 it was destroyed by fire and razed.

Way off topic, just reminiscing, went to UNLV in early 1990s. Knew Valerie Pida. Lovely young woman who passed from cancer. They named a plaza after her. I remember her reading while working out one time. Always had a great attitude. Anyone else remember her.

I went to Chaparral High School with her in the 80s and UNLV with her in the early 90s.

She was quite literally, the cheerleader that everyone loved because she was so kind to everyone. The praise and adoration that she received then and now is definitely warranted and not just some series of puff pieces that are good for PR.

She earned every good word that has ever been said about her, even 30 years later.
