It Only Takes One

  • Facing the Nevada Commission on Judicial Discipline yesterday, Judge Steven Jones stated he was remorseful for making one mistake in his 25 years of service and will be withdrawing his bid for reelection. While that seems like the right thing to do, one wonders why it took him so long to come to that conclusion. After a day full of testimony from witnesses testifying about the negative impact his “mistake” had on the family court, a decision from the Commission on his punishment could take several days. • Five Boulder City residents, represented by Tracy and Linda Strickland, were validated by the Supreme Court of Nevada yesterday when the Court upheld their claim that a suit against them by the city was a SLAPP (Strategic Lawsuit Against Public Participation). [RJ]
  • Attorney Chris Reade, who pleaded guilty to money laundering last week, faces up to 10 years in prison. [Courthouse News Service]
  • If you or your clients had property in the fabled, but now-bankrupt, 24-7 private vaults, Attorney/Trustee Brian Shapiro is setting up times for owners to obtain their valuables (they will have to go through the eye scan, know the code, have keys to the safe, and sign a document at the end indicating their safe is empty). If you need to set up a time, email Brian Shapiro directly or call him at (702) 386-8600.

The first time I heard about "Mr. Elliot" and his 24-7 private vaults, only one thing came to mind: How the hell could they possibly comply with unclaimed property laws? What happens when someone stops paying? Sure, they lose access to their stuff, but seeing as the proprietors don't know whose safe it is, they can't give proper notice if they wanted to open the box and sell the contents to pay for past-due storage fees. They also can't turn the unclaimed property over to the state since that requires a name. It's a business model that just seemed fraught with impossibilities.

Seems like a great business model to me. Most customers are likely hiding assets (cash, jewels, etc) for some reason or another (illicit profits, hiding from ex-spouse, etc). I seriously doubt anyone is using Private Vault simply to store important papers or anything but cash or jewels. The owner could keep the cash or jewels from the vault and who is ever going to prove what assets were in the vault or even know the assets were there.

Albright gets a lot of these plaintiff side derivative suits. Wonder how he has become a go to guy on these.

Jones has some balls. Goes into the first hearing with guns blazing "I'm unfairly targeted. My privacy has been invaded. I've done nothing wrong!" Then he gets his ass handed to him and goes into the penalty phase all contrite and shit. What a clown.

Agreed. JJJ argued (just this week) that the RJ "unfairly" targeted Jones. That's not contrite, that's caught. Remember that Jones also had his staff help Lisa Willardson draft her response to the bar. On County time? While his clerk was too busy to take a phone call? Then there is the mistake coming in Federal Court in March; that was the mistake with Winkler. This is the first "mistake" conviction.
