I'll reserve judgment until reading the complaint, but this sure sounds like it's on the edge of a Rule 11 letter. They already did a statewide recount and determined Gilbert got 7 votes *less* than originally reported.
So what’s the supposed “geometric formula” or whatever? You multiply Nye by the hypotenuse of an isosceles triangle and subtract half of Pershing? I mean seriously, someone explain this to me.
You get a 30 day extension automatically, then a 7 day. That is 67 days to file an answering brief. If you are filing an opening brief you get that same time period, but you also get the months of lead time until that time period starts because of how appeals work. How much time do you need?
Obviously answering a Writ is different, but you have already briefed it at the lower court and you still get the 67 days minimum.
I agree with your sentiment 11:56 but the automatic extension is only 14 days in the NVSC. Ninth Circuit is the auto 30-day. Often the better thing to do is to stipulate with opposing counsel if you need more than 14 days – I've never seen the NVSC reject a 30-day stipulated extension *if it's your first request.*
You can just file a motion for 30 days and they give it to you. You also get the 7 day telephonic extension. Obviously a motion saying there is no objection or stip is best. I have never refused an extension for appeal briefs.
You cannot get a telephonic 7 day extension if you've already been granted a prior extension. Use that sparingly, in my experience, because getting a second extension requires a heightened showing.
I had opposing counsel stipulate to an extension (for motion work, not briefing) in front of NVSC and the NVSC Clerk rejected it. Fortunately, it was just motion work, like I said, but it was surprising. I would not rely on anything except the one time telephonic extension going forward.
Supreme Court is ordering people to settlement conferences and THEN dismissing for lack of jurisdiction. Shouldn't you ascertain jurisdiction before you enter orders lest your orders are void for want of jurisdiction? Oh Hardesty & the Hellions you slay me.

Why would she be off the bench? She's presumed innocent until proven guilty, or'd you skip that day in law school? Plus know the facts before you assume anything, the case is dogshit.
I'm the original poster of the question @ 2:31 p.m. Sorry if I somehow touched a nerve by asking what I thought was a fair and safe question. There is a precedent for public servants (including judges) being placed on PAID administrative leave while charges are pending. And while I'm not a criminal lawyer, I thought that using the term "arrested" and not "convicted" showed that I wasn't assuming anything. I happen to like this judge. I just wanted to know if she was on the bench still. I appreciate those that answered without insulting me and assuming that I was assuming anything.

I voted for Gilbert (mostly because I think if there was another wave of lockdowns he would be the least likely to do so, and I'm not a fan of mandates).
However, this is simply an issue he can't win. Minimal upside, HUGE downside.

As someone who firmly believes the 2020 election was stolen due to the substantial amount of irregularities that took place in the five key swing states including evidence of actual fraud that took place in Georgia (drop boxes, Ruby Freeman, as just two of many examples), Arizona (the discrepancies with military ballots and Guillermina Fuentes in Yuma), and Wisconsin (illegal drop boxes), I think Joey Gilbert is a crackpot who has absolutely ZERO basis to contest the primary election. Given the relatively low turnout with the primary and the margin between him and Lombardo, there's absolutely no way he can prevail on his claims even if they were thoroughly investigated.
As a Trump supporter, he does not impress me at all. Quite the opposite.
I'm opposed to mandates too. My neighbor was being loud and wouldn't stfu so I shot him. Told the cops I'm against mandates and they were cool about it. 'Merca!
