A recent post to the NJA Listserv has Adam Stokes asking, “Who is aggressively handling legal malpractice claims here in town?” He then says to message him privately for a referral. While it doesn’t say whether he is “asking for a friend,” it does raise a good question: who out there among us is a cannibal willing to go after bad lawyering without a badge from the Office of Bar Counsel?
The level of incompetence and malpractice in this community is astounding! Someone needs to hold the bad attorneys accountable and return the practice of law to an honorable profession rather than simply a license to steal.
I am not. I am also not surprised at the level of stupidity of some of our judges. Yawn, I have some more cases to take on and win.

I am actually more surprised that lawyers are reluctant to go after others in malpractice cases. We all whine about the State Bar being slow and incompetent, yet when we have the opportunity to right a wrong another lawyer created some of us are hesitant to do so. Why? Isn't this why we became lawyers? to hold others accountable for their misdeeds? I guess not if its another lawyer. I have no qualms going after attorneys. If you did a shoddy job, then you shall pay the consequences. I do this with every other defendant, if that person happens to be a lawyer, theres no difference in my approach.
I will not sue other lawyers. I feel it is bad karma. Sooner or later I will probably have a questionable malpractice claim. I do refer the client to counsel if it is egregious. Dennis Prince used to do malpractice. Not sure if he still does over at Eglet's office.
3:11, its karma for being a dumbass a lawyer and blowing statute or a huge deadline. I would believe a lawyer would know the difference between a silly mistake that wasnt dispositive in the client's case outcome and something huge like blowing expert deadlines or statute.
311 Boyz here. I am not talking about blatant SOL errors. I am talking about strategy. Sometimes an expert is not needed, but if you lose the case it will be said one was needed.

Generally agree with not going after other attorneys, karma, etc. but here's an interesting hypo based on a similar case I had which I will throw out to the commentators. Had a PI client who retained "bad attorney" who sat on case did nothing and by the time "bad attorney" withdrew had done nothing and blown several important SOL's with regards to various theories of liability against multiple Defendants. Assume hypothetically you retain this client and client's claims against various Defendants have merit but for the fact they are past the SOL. What would you do, as it relates to prior "bad attorney"?
Bring the malpractice claim or refer to counsel to bring the claim.

Metro cop hired Josh Tomsheck. Seems like all cops and lawyers that get in a jam hire him. Good move. Headlines sound bad but I bet you dollars to donuts Josh gets him out of it with no felony, no time and he keeps his job.

2. I hope I never have to sue a lawyer for malpractice. But if I ever had to do something like that, I might start by placing a call to Gary Logan.

Very few lawyers I know I have any good karma. Just sue them. Bar counsel doesn't do shit e.g. Marissa Border.
