So the news came out yesterday that District Judge Donald Mosley will be retiring March 2nd. Good for him, right? The only problem with that proposition is the timing. As the RJ points out, Judge Mosley’s retirement comes just 10 days before Dr. Dipak (“Needles”) Desai’s criminal trial. For those of you who have been in Cambodia (or maybe just Pahrump) for the past few years, Dr. Desai ran the Endoscopy Center of Southern Nevada where patients didn’t ask for Hepatitis, but left with it anyway.
Dr. Desai’s criminal trial has been proceeding before Judge Mosley for approximately 18 months now. Judge Mosley’s departure will almost certainly delay the trial, which is scheduled to start March 12. Although the timing of Mosley’s retirement seems quite convenient, he is turning 65 on February 28th, and we all know that judges are forced to retire within a week after turning 65, right?
I imagine Chief District Judge Jennifer Togliatti is wringing her hands right now trying to decide who should be the lucky judge (or should I say law clerk? We all know the clerk is the one who will get screwed here) to handle this case. Apparently this case was the result of one of the biggest investigations ever conducted by Metro, which is why there are more than 1 million pages of documents produced so far. After handling this case, the judge who takes over may be forced into early retirement as well! Good Luck!
What do you think is this just an unfortunate coincidence, or was there some strategic timing involved in Judge Mosley’s decision? Who do you think will replace him? The article said that both parties sides had conceded that the trial was not going forward next month. Should we give Mosely the benefit of the doubt and say that he has been wanting to retire since the incident(s) with his son, but has held out due to a sense of duty? Perhaps, he is one step ahead of most of the other district court judges and realized he is in over his head.
The horrible thing is that it allows for another appointment from the small group of volunteers (read: people who the voters rejected) that show up every time there is an opening.
I heard Judge Hardcastle will be going in a few months as well. Any news on her exact date?
Judge Mosley, has been a wonderful judge for the citizens of Clark County. His retirement will be a huge loss for the justice system. He has been a mentor for many and from what I know, he has always planned to retire, around his birthday. His 33 years of public service needs to be commended for being the longest sitting judge. The people of Las Vegas, re-elected him for Department 14, because they knew that Clark County, needed a no nonsense judge. A judge who would be dedicated to make sure that the streets were safe. He knew when to give a defendant an opportunity to change their lives for the better or to REVOKE their probation and sentence those who needed life in prison. I wish Judge Mosley and his girlfriend T. K., a very happy life. They have both endured the harsh campaigns together, while dealing with sensationalized stories from the MEDIA, not to mention blogs. I am glad to know that the two of them have worked through the difficulties of the bizarre former girlfriend of the past. (Mother of son)
By the way, Hardcastle, will be leaving her department sometime in April. Also, I am sure that there will be a competent judge to hear Dr. Dipak Desai's case. Question is: Are the ATTORNEY'S prepared for the trial?
The only thing I know about mosely is that he has a craaaaaaaaaaaazy ex girlfriend that used to hang out at BK court. Not trying to incite her to comment if she's a reader (I know she used to comment on wild wild law) but seriously if she's only his ex girlfriend and not his ex wife, why does she have his last name?

Well, everyone is still waiting to hear why Ron Titus got fired 13 months ago. I'm sure, like everything else, who the hell knows why Mosley is retiring. Do you honestly, realistically think you will ever know the truth behind this obvious last-minute decision — perhaps forced by the powers that be, sitting much higher in the scheme of things, as in powers that sit higher than the state level of government? Ah, but to do this in the face of a major trial? All his responsibilities in terms of hearing name changes got taken away last summer didn't they? Something has been knocking him, lynch-pin-by-lynch pin, further off the bench. Well, let's add that to the list of unanswered public questions along with the 13-month wait on why Titus fired. Got to be a sure sign you are losing your power if you can't play god and change someone's name and identity. Good price paid for that kind of thing in Clark County, and it can be wheeled right through the legal sytem without a hitch, as long as you know "who the legal connection" is, you know, your go-to-people for that kind of thing. Those go-to kind of people also tend to have the "inside scoop" on the be-hind the scenes issues; they make money on those too.
Someone mentioned ErRaTiC CaPs HawkEye last week, now the Titus deal 13 months later — still no answer — Why Fired? Got me reminiscing about what was going on in the legal blogosphere world here in Las Vegas just about one year ago at this time. I distinctly remember HawkEye posting to the LVLL commentary about "…a Tsunami…right here in the middle of the desert…can you imagine that?" With all the shake-ups and shake-downs of judicial power positions and criminal actions filed against local attorneys, all occurring in a rather rapid-fire fashion, I'm starting to see the deep blue line of a wave crest coming up over Mt Charleston. Someone better tell Smith he doesn't need a bigger boat — What he needs is an aircraft carrier. I hear the USS John F Kennedy is birthed but is available for public use. He might want to consider that as an option. I think I see the first wave of that Tsunami breaking down the mountainside now. Here's to a playful retirement for Mosely — he's good at that — will get to spend all his time doing IT now. Might lose some playmates in the crash of the Tsunami though. They call that collateral damage and all participants are instructed to toss it to the wayside.

Oh-Could this be the superflush that's been whispered about throughout the hell-hallowed halls of the Clark County justice system? Oh–I have a suggestion for next Friday's thread for consideration. How about we all be just as salacious as always and next Friday run the topic of: Whose the collateral damage question? Any tips or leads out there? Oh–I'm all hot and bothered right now just thinking about how much fun we all can have drooling over the pitiful career falls of those seductively sucked into a game that ultimately ended up swallowing them whole. Oh…What fun on Friday!

About those trolls that we get our jolley-whallies going by kicking around here-makes us feel superior–have you noticed? For the past 6 weeks or so there has been an absolute almost cease and desist of community commentary in LVRJ by these whack jobs. Rumor has it that they have taken all their issues to higher ground. Could that be why someone else is seeing that wave crest and go over Mt Charleston? I heard you can get front row tickets for The Viewing right here. Is that true?

I don't think Mosley was forced out; he has the time in the system. I heard he only stayed til March to give his JEA more time in PERS because the County will not find her another job. As to being forced out by taking work away, I don't think so. Mosley has been famous for refusing to do the extra time of work that the other judges do. He would have loved it if more work was taken away.

I am pulling for Bruce Gale to replace Mosely. We need him as the male counterpart to balance out Leavitt's incompetence and craziness. Sort of a ying and yang deal.Plus we need more ammo to comment about now that Steve Jones has gone temporarily undergound.

Speaking of Judge's and their JEA's…is it true Judge Kishner has gone thru 3 of them in her first year on the bench?
