Interesting guy, Holper. Originally was a chiro, then went to med school somewhere in Latin America before coming to Vegas. For decades ran a personal injury clinic on Charleston catering to the mid-level PI industry. Managed to stay clear of the Medical Mafia world of Awand, et al. He outlasted a lot of the old Vegas PI doctors. 41 months is a pretty stiff sentence.

Yes he was a decent PI doc, but there was another side of him that gave pills, lots and lots of pills, to addicts. I will simply refer everyone to the public record available at medboard.nv.gov

I liked Dr. Holper and found him to be very fair with the P.I. cases I sent him. However, he was a little liberal with pain meds.

I tried to find the case that Lowry wrote about. I want to read the briefing. Does anyone know the case number? It's in federal court apparently. No need to post the names of the attorneys here for shaming. Anonymous internet shaming sucks.

All of that snark makes his blog insufferable. While there were clearly multiple eff ups by Plaintiff counsel here, I will say that I have filed lots and lots of complaints, and that once I receive authority to file, I generally I don't think to call the client to verify that he or she is still alive before I file, serve, get the answer, and either move to exempt or get through the EAC process. So if someone died shortly before filing, it could easily be 60-90 days before I might find out about it. But with that said, once you know, you have to act, and these guys plainly screwed the pooch.

The state court number appears to be A-17-7565553-C (guessing based on filing date and this is a slip and fall case). It was removed to federal court aby Panda express and that number is 2:17-cv-2105

after reading lowry's blog complaining about not following the rules and the recent NRCP rule changes, it really seems to me he is a big stiff and has a hard on for following the rules to a T. ironic being that as lawyers we learn that everything isnt black and white, rather it is in various shades of gray. And I agree with the judge that the court shouldnt punish the plaintiff for something its counsel did. Plaintiff's counsel is paying out of pocket in sanctions, isnt that god enough? you really want to ruin a individual's claim too? (regardless of said individual dead or not).

That personality trait is why his blog is so informative though. Compelling Discovery is by far the best and most informative legal blog in Nevada. Lowry does a tremendous service to the legal community by hosting it.

Lowry openly acknowledges what many of us have seen: If you refuse to enforce the rules because you don't want to hurt a claim, the lawyers stop following the rules. You get flagrant discovery violations, and monkey business like that.

The answer, of course, is to enforce the rules in an even-handed manner, acknowledging that they are intended to promote the speedy administration of justice (for both sides, BTW), and let the people who hired the assholes who either don't know the rules (NRPC 1.1) or who ignore the rules file malpractice claims.

It's both comical and sad the first reaction to a compliment on the blog is that the author must be the recipient. I cannot speak for the others, but I am 10:57 AM, and I am most certainly not Michael Lowry. Hey, I have an idea, what if we, as a profession, went out of our way to note the successes and admirable talents of others instead of tearing each other down? It doesn't diminish your stature to note the praiseworthy attributes and accomplishments of your colleagues. Plus, this is such a shitty, miserable profession, do you know how much it makes someones day to receive an unsolicited compliment?

I am not 1:16. I am not certain Lowry's blog has more readers, but I suspect it does simply because it has a national audience and this one doesn't. I would also guess that more Nevada lawyers read this blog than Lowry's.

In addition to the Blawg 100 win that's he's had a number of years, the simple fact is that his blog focuses on FRCP. That applies to a large number of attorneys, not just ones in Nevada. Sure, some of his posts focus on NRCP and his encounters in state court, but most of them are relevant to a much larger audience than this blog is. Don't get me wrong, I love this little blog, but the comings and goings of Nevada lawyers isn't nearly as, dare I say, compelling, to out of staters.

Objectively: this blog smokes Compelling Discovery. If you go look at where they rank on Alexa, this blog is ranked at 440,885 and Compelling Discovery is at 2,219,368 (https://www.alexa.com/siteinfo/lasvegaslawblog.blogspot.com vs https://www.alexa.com/siteinfo/compellingdiscovery.com). That said, I think our community is lucky to have both sites.

I read the Order affirming the dismissal of that case against Prince and Ranalli. Speaking of monumental screw-ups by insurance companies, I also heard that there was a $68 million arb award against GEICO recently in a case where they wrongfully denied coverage under a $15,000 policy. Couldn't happen to a more deserving group of folks. Anyone have further details?

The California Assembly Judiciary just approved a bar dues increase to $544, a 29% increase over 2019. I know, many of you will say Oh..Hum. But if affects me directly and may be a forecast of future Nevada Bar dues.
