Has anyone else read the Kutner Complaint (A688898)? So in 2008 and 2009 Kutner alleges he was defamed on WWL by WWL linking to a CityLife story in 2008 and 2009 but had such a burr in his saddle that by 2013 Kutner was trying to contact "LegalEagle" to take down the posts on an inactive blog. The allegation is not that the Blog Posts were defamatory but that they merely LINK to a defamatory news story; of course Kutner is not suing the newspaper because the newspaper might actually put up a defense.

So Kutner would like to silence the internet. Honestly I had no idea and forgotten that people said bad things about you over 5 years ago Adam until you brought this up. But I like free speech more than I like your A.S.K. advertisements so here is the link to the story for purposes of confirming that this story was in fact actually published and with the right of others to confirm the veracity of the informtion which was alleged in this story. http://archives.lasvegascitylife.com/articles/2008/05/22/news/local_news/iq_21648475.txt

Of course when I Googled the name and story, I was sent directly to the Stephens Media website so perhaps silencing Stephens Media 5 years after the fact will be next.

Perfect opportunity to put the new Anti-SLAPP laws to practice.

Wait… so Asshole S. Kutner was responsible for WWL going inactive?

The new anti-SLAPP lawsuit went into effect October 1, 2013, so probably not applicable here, unfortunately. I couldn't get the case to pull up on Wiznet. Was it filed after October 1?

Kutner filed September 19 so the new anti-SLAPP does not apply, unfortunately. I believe this is precisely the type of lawsuit that it was intended to thwart.

Apparently this all went down just before I moved to town in 2008, and I had never heard a word of it. If' Kutner's goal was to invoke the Streisand Effect so that everyone would be reminded of what an asshole he allegedly is/was, he seems to have been quite successful. Good job Kutner!

I'm guessing the reason he is going after LegalEagle and WWL is because it is the 4th search result in google when you search for him–right below the 1 star rating on Yelp.

Anti-SLAPP may not work, but you know what will: Statute of Limitations.

Good call 9:32. NRS 11.190(4)(c). Two years. The SOL ran on this long, long ago. In any event, I've popped some popcorn and can't wait for this story to keep developing.

Rendazza does a lot of the Vegas first amendment cases. It's the niche he's dug out. I think there's a good chance he gets it. I almost feel like e-mailing the guys and offering to do it pro bono. Doesn't sound like a hard case at all, and it would get your name in the papers.

What the heck happened to the Vegas office of Lewis Brisbois? They used to have like 30 lawyers there didn't they? Now the website only shows 11. Any insight?

I'm surprised I haven't seen this on above the law.
