Excuse Me, Is This Seat Taken?

  • Has the Public Administrator’s position ever gotten as much press as it has this year:  Republican candidate for the office arrested for DUI. [8NewsNow]
  • This updated announcement of Justice Abbi Silver’s retirement mentions that the application for being appointed to Seat F will open in September.  Its chambers and duty station will be based in Carson City. How is that going to affect who applies for this lucrative two-year stint on the Supreme Court?
  • Here’s a little blurb about lawyers for the Raiders. [Bloomberg Law
  • Not law related, but in comparison to yesterday’s post about longevity at jobs, shout out to Benny Figgins on retiring after 55 years at Caesars Palace–the last remaining original staff member. [RJ]
  • And a shout out to County Manager Yolanda King retiring after 33 years with the county. [RJ]
  • Hiring managers–do you ever look negatively on someone for staying at one place too long?

I lean on the Forgiving, give people a break side usually but if you drive drunk, then you cannot manage your own life and I do not want you managing anything to do with my life e.g., Public Administrator

This is nonsense. Soooo many people get in their cars and safely drive home when they're right on the line. There is a huge difference between a completely wasted person, speeding and weaving in and out of traffic, falling down drunk by the time they get arrested vs someone who just had an extra drink at happy hour. That doesn't make those .08ers terrible, unforgivable people.

There've been many times where I've thought the person driving in front of or next to me was drunk, but when I glance in their car they're on their phone or reaching into the back seat to deal with their bratty kids or they're talking to a passenger. Distracted driving is as bad if not worse than someone who had 1 too many and blew an .08 at a DUI checkpoint.

12:07, I respectfully disagree, I agree that "Buzzed driving is drunk driving," sometimes literally 1/20th of a second separates death from life and even a small buzz makes all the difference, I do agree with you though that ANY distraction is just as bad, perhaps I am a little biased because I remember a Partner at our office in the 90s who had both his children killed by a drunk driver while driving to Phoenix, the other partners gave him 6 months off, when he came back he looked like the guy at the end of the movie Platoon, his face was sunken and his eyes strange, he was never the same up until when I left that office, thank you for a respectful discussion by the way and have a safe holiday

Along those lines, OP, our AG Aaron Ford couldn't get his life together enough to pay his taxes and avoid an IRS lien. Lowlife.

Fortunately, the Public Administrator doesn't manage anything to do with your life. Your death, maybe.

Also, you would think that a letter issued by a candidate for public consumption would be much better proof-read. I am glad that her drunk driving was wreckless.

12:07 here – to be clear, I'm not a fan of drunk driving or buzzed driving. I just think we need to steer clear of absolutes. OP that anyone with a DUI cannot manage their own lives. That's a bit extreme and ignores reality. Anyways, we have uber and lyft. Use them.

I was willing to forgive her until I read her b.s letter:
" A police officer recognized that my headlights were dim and stopped me. The officer discovered that I was an emotional wreck due to the recent passing of my father. The officer wondered if I was impaired and administered a field sobriety test, which I passed. However, the officer tested my blood which revealed a high blood alcohol level due to me consuming alcohol earlier in the day. Although I was
not drunk or driving erratic or wreckless, (sic) my blood alcohol level was higher than the legal limit. The officer was obligated to arrest me for a misdemeanor offense and I cooperated. " If she had a high blood alcohol level, she was impaired. If she passed the field sobriety test, why was she arrested? And the police officer does not conduct the blood test, (and certainly not at the scene) a nurse draws the blood and the Metro lab tests it. I also am not found of impaired drivers who drive at night without headlights. Oh, did I mention I live near the scene of the arrest, so she was apparently driving around my neighborhood?

And she had a red solo cup and open bottle of vodka in the car – but sure it was the beer from earlier in the day that made her BAC over the limit.

So she's extra dumb because if you actually are not intoxicated and thinking clearly, you would realize that you shouldn't drive with a red solo cup and open bottle of vodka.

Would have been better to say I did wrong, I learned, I won't do it again – and mean it!

Here is the link for the first bullet: https://www.8newsnow.com/i-team/las-vegas-area-political-candidate-arrested-for-dui-with-cup-of-alcohol-in-car/

Why do we even elect this position? Seems to me it should be a competitive appointment with public hearings on the applicants, etc.

The only down side I have noticed to hiring someone that has been at a place for a long time is that they tend to be very set in their ways. We hired an old, crotchety receptionist once who had been at another firm for decades. Brought her in and she just kept insisting that she knew how to do everything. We kept telling her that we used completely different systems and that she needed to be trained, but she was weirdly obstinate about not being trained. I think she thought it would make her look less capable or something. Ironically, her refusing to be trained and as a result being inept at everything made her incapable of doing her job and we ended up having to fire her. It was evident that she had been very comfortable in her niche for far too long and didn't have the ability to adjust to anything new.

Sounds about right. It breaks my heart when that attitude is displayed by a new attorney who is fresh out of law school. If you don't want to learn or listen, just bypass the private sector and go straight for LV, NLV, Henderson, and the AGs office.

I'd hope the State Bar of Nevada may look into this. They state "Under Nevada law" 3rd full paragraph on the 3rd page and goes through slander under Nevada law. I'd hope…. I don't expect, but I'd hope.
