I think that too much is being made over a barricaded suspect telling the police that he's going to get high before he surrenders. It strikes me as somebody wanting to find controversy where there really is none. I feel as if the people raising this issue think Metro should have refused his surrender when he said that he was going to use marijuana. Nothing that Metro could have said or done (other than a dynamic entry and shooting him) would have stopped him. However, questioning him immediately after surrender (and while self-intoxicated) can and will raise issues. Just my humble two cents worth of opinion,….

After Governor Sandoval signed the Homeowner Protections Bill of 2015, Cookie Monster was unavailable for comment, but sources say he was thrilled about the prospect of less cookie eaters in Nevada.

Prediction: Not one competent lawyer will lose his or her job as the result of AB125. Everyone will adapt. The train will keep on rolling. And Terry Riedy will still have more money than he can ever hope to spend.

Anyone who believes that amending Chapter 40 in piecemeal fashion will do anything but create more litigation is deluding themselves (Don't forget that Chapter 40 was allegedly written to prevent litigation). Litigation surrounding indemnity, sufficiency of Chapter 40 notice, compliance with the pre-litigation requirements for homeowners, etc. will go on for years. Six year statute of repose you say? The statutes of repose are rarely enforced in multi-home cases. Eventually, a newly elected legislature will swing the pendulum back anyway. It's the nature, not the scope, of construction defect litigation which will change. The number of construction defect claims has steadily declined in recent years. AB125 may just be the meal ticket the industry has been hoping for.
