In District Court Department 4 we have Judge Kerry Louise Earley seeking reelection against Steve Smith. (More info at edjudicateclarkcounty.com and Vote411.) You know the drill–who should be elected and why?

In other news:

  • The Court also ruled that strip clubs are not unfairly targeted under the live entertainment tax. [RJ]
  • The Nevada Commission on Judicial Discipline will consider a lifetime ban against Steven Jones to keep him from running for judge again after he gets out of prison (and after he reapplies for and gets a law license). [RJ]

Tough choice. Smith would likely be an ethical and impartial judge; but he has poor people skills and isn't particularly bright. Earley, on the other hand, is more than up to the job intellectually and can handle people pretty smoothly. Her problem is that she's beholden to a few powerful attorneys and interests who have propped her up and gotten her into office. God help any litigant or lawyer who might have a case in Earley's courtroom where the adverse party is represented by one of Earley's friends.

I am voting for Smith. I give the guy credit for running against her.

I have been in front of J. Early a variety of times. She has excellent judicial demeanor. She fully explains her decisions and even though I disagreed on one of her decisions, she fully analyzed the issue. You can't expect anymore out of a Judge.

In regards to Smith, I wish him luck, but it is hard to oust a good judge for someone that has not been on the bench. Too bad he did not seek a different department.

Ditto….9:24–Voting for Steve Smith. Think he will try hard not to play favorites and call the cases appropriately. What happened to all those negative articles in the newspaper about Earley?

Three emergency landings in two days. JetBlue in Long Beach – smoke filled cabin after right engine blew up. Virgin in Las Vegas – smoke in the cockpit. Another aircraft at Indian Springs – ambiguous in-flight emergency. I hope that they are all unrelated.

Smith is independent, smart, and would make fair rulings. He is not beholden to nobody and that is what I want in a Judge.

I wouldn't vote for Earley if she were the only person on any ballot. She is haughty and rude and thinks she's hot stuff. We need a judge who makes decisions based on the facts, not on how important they think they are. Steve Smith is the right guy.

Steve Smith may not be the most exciting guy in the world. He may not be the most scintillating conversationalist, or the most tactful, or the most well-liked, or the second-coming of Learned Hand. Plus, he still has his New Jersey accent. HOWEVER, in all seriousness, this is a case of "don't judge a book by its cover" – he is certainly smart enough, knows the law inside and out, would be scrupulously fair, and would be one of the hardest working judges we would have on the bench – an important factor. He would be an excellent judge.

Perhaps. But we have pretty much all of that now. Bird in the hand…

I have known Steve Smith for 15 years. He is a straight up, ethical attorney, knows the law, is a credit to the Nevada bar and will be a needed asset to the bench. The breadth of his experience extends well beyond that of the incumbent. He has my vote.
