I respect Judge Michael Luttig a great deal. The fact that his letter (or the letter that his the first signatory) has not a single retired judge from Nevada signed on is a negative to giving it any weight.

As someone who has litigated with her and against her and is a Republican, its her lawyering that renders her unqualified. I said the same thing about Frierson. Neither are qualified for this job. Dan Bogden was qualified. Greg Brower was qualified. Neither of the most recent two are or were qualified.

By “here to stay,” do you mean to suggest that when her new 210-day extension is up, the administration will simply continue to extend her tenure on a “temporary” basis without submitting her candidacy to the Senate for its consideration? And by “get used to it,” do you mean we should get used to such top-down circumvention of the federal confirmation process as a general matter and cast separation of powers by the wayside when it comes to similar executive branch appointments?

Here is an interesting conundrum.
-Nevada Supreme Court Senior Judge Calendar lists Judge Jerome Polaha hearing cases in 2nd Judicial District Court
– As noted here last week, Judge Polaha irrevocably resigned from the State Bar of Nevada.
So you have a sitting judge who is not eligible to practice law in this state.

In fairness, Jansen has been hearing cases in Vegas without a law license as a pro tem JP for decades (if not centuries), at least with Polaha you have a lawyer, even if resigned.

@3:28 looked it up and you’re right, honestly the scuttlebutt I always heard about it was that he was an FBI guy who got elected out in the rurals where you don’t need a license and has just been filling in as a pro tem since he lost his last election. Nope, licensed attorney for a time. Turns out he was also president of the county bar association at some point – trust but verify I suppose.
