I have a few questions for our colleagues in the criminal bar, re: Rob Telles.
1. Assuming this goes to trial, what do you expect the time frame to be? Sequence of events?
2. What is the probability that the DA and Telles enter into a plea agreement? What incentives do you see each side acting on, towards or away from such an agreement? I ask because it seems like neither side has much incentive to come to an agreement here, but I don't practice criminal law so I probably have no idea.
3. Isn't there a "special" public defender for high profile cases? Is that what Telles is getting here? Practically speaking, does Telles have real resources here to defend himself? Also, given that he was making $120k a year, how could they so quickly determine he is indigent? If he is indigent, isn't almost everyone?
4. What do you think the goals and objectives of the defense will be? To lay eyes, the evidence seems like an avalanche of damning facts. It looks like the DA could go to trial on 1/4 of the current evidence and still dunk it. Is this going to be a fight over admissibility or sanity?
Regarding question 3, the Office of the Special Public Defender represents people accused of offenses that carry a potential sentence of life in prison or the death penalty, if the Public Defender's Office has a conflict of interest. This often occurs in there is more than one defendant in a case or if the PD's office represents an alleged victim or witness. Our office has 19 attorneys (and we're in the process of hiring 3 more), in addition to investigators, mitigation specialists, a social worker, and support staff. Most of our cases are not "high profile." I'm happy to answer additional questions about our office. We do not represent Mr. Telles.

Maybe that was true before the murder, but the RJ has plastered his face on the front page of the paper and on the opening window of their website everyday for weeks. Germin's murder was a NATIONAL news headline. I would guess that – at most – half of the city has not heard the story or heard Telles' name.
Does anyone have a case number on the Complaint filed by the DA to remove him from office? It seems like media outlets, including the RJ, used to be better about posting pleadings with their stories.
They used to be be better before treasonous shitweasels that the RJ's owner supported started to file absurd lolsuits in an attempt to overturn an election defeat. Can't have those documents attached to an article.
2:49, I'm assuming your inquiry is sincere, in Domestic Law in Nevada (in general) each spouse's income is part of the community (I am a Family Law lawyer {I know, cry for me later haha}, our questions was in Criminal Law does the Court use the spouse's wages to decide if a party qualifies for a Public Defender, I have no idea but do think it is a fair and sincere question. I'm sure someone else can explain this better but that is my take
A change of venue would be for someone who was well known before the crime. Many murders make local, regional and sometimes even national headlines. They don't get change of venues. Telles was not, before his murder, known by probably more than 1% of Nevada public.

Sincere inquiry and I may be overthinking it. Assuming that Telles paychecks stop, he would be indigent. Unless his spouse makes a lot of money, which I did not see any discussion of above. That said, given the low key middle of the road home in Peccole Ranch. I assumed she was nominally employed or a stay at home Mom. I too, am versed in Family law.
That said, I have seen the PD appointed when the D was incarcerated and not bringing in his previous income with a bare bones review on the record.

10:28-And, far more importantly than him being a good dude, it's he's easily one of the best and most experienced Public Defenders in terms of defending homicide cases.
So, with all due respect to Travis Shetler (who, is in fact, a good lawyer), Telles made the right decision IMO.
And for those who post here and keep insisting that the evidence is so damning that it does not matter who represents Telles, it is clear that those posts are from a non-attorney(or, if from an attorney, they are a Boyd graduate–just kidding)..
The evidence IS damning, don't need to be an attorney to see that. This isn't some Casey Anthony nonsense. There might not be a plea deal that makes sense for both sides so, if it goes to trial, he has like a 1% chance of it being second degree murder and that's probably his best move. State will certainly never take life without off the table.
Serious question. What is your best move if you are Telles?

Looks likely that criminal charges may follow the Hsieh fiduciary people. Wonder if there will be blowback on Premsrirut, who was his attorney?
I have LOTS of issues with Puoy but the report says that she tried to get him into treatment and stop his slide. Other than the $2.2M flat fee which might run afoul of NRPC 1.5 for reasonableness of a fee, nothing seems to indicate that she received anything untoward.
But you have to put in the 2200 hours. Can it be shown. Again, itemized records/billing is necessary to show reasonableness, plus at $1k, substantiation of superior legal skill/novelty, etc.
Flat fees do not have equal the number of hours on a lodestar basis, merely be a reasonable approximation. And you can ask Puoy how much she thinks she is worth and she will gladly tell you.

Motion for Change of Venue would be my first thought, not that it's going to make much difference
I was wondering the same thing about indigence.
Telles's wife cut him off from their finances and is collecting all his paychecks into her account. So, yes, he is indeed indigent.
Change of venue to where? Pahrump? Elko? Reno?
And the argument is what? That local media coverage is too intense and too personal?

Ed was a DA in the late 1970's and 1980's. He is a good attorney and a good guy.

Not as hard as you think. You don't have to itemize a flat fee; you only have to show it was reasonable. 2200 hours at $1000/hr is $2MM.
