Boy I liked Boulware when he first took the bench but he has become incredibly sloppy in his decisions. We have two cases with him where he ruled on issues which no one brought up because they were completely inapplicable to the action.

Just had a judge grant a motion for fees and costs that had never been filed, never been briefed, had no Brunzell factors. When counsel asked how the court could award fees and costs without a motion and without even knowing how much the fees and costs are, Juge Ballou stated that whatever the fees are she was finding them to be reasonable. The gift that keeps on giving.
NRCP 54(d)(2)(A) and Winston Prod. Co. v. DeBoer (122 Nev. 517) says fuck her judgment, and appeal that shit as a special order within 30 days of the NEO, subject to any tolling motions. If the (d)(2)(B) 21 days for filing the motion has already passed thanks to the court’s sua sponte granting of the mystery motion, OC can go fuck themselves, since that’s jurisdictional. Just watch out for (d)(2)(B)’s “unless a court order provides otherwise.”
No longer messing with life and liberty, now messing with property and treasure. I guess the silver lining is that your record is rock solid (based on what you are saying). It will be interesting to see what tone the Supremes take when they overturn her.
